What a Landscape Pricing Agreement Covers

A Landscape Pricing Agreement is a written contract that sets out the scope, schedule, and price terms for landscaping services provided to a property owner or manager. It typically defines services (planting, mowing, irrigation, seasonal maintenance), delivery frequency, unit prices or lump-sum charges, payment terms, change order procedures, and responsibilities for permits or materials. The agreement can be used for single projects, seasonal programs, or ongoing maintenance and often includes termination, insurance, indemnity, and dispute resolution clauses to allocate risk between the contractor and the client.

Why a Clear Pricing Agreement Matters

A formal Landscape Pricing Agreement reduces ambiguity about work scope, establishes payment expectations, and creates an enforceable record of the parties' commitments under ESIGN and UETA where electronic execution is used.

Why a Clear Pricing Agreement Matters

Who Typically Prepares and Signs This Agreement

Common preparers include landscape contractors, property managers, and commercial facility teams who need predictable budgeting and documented service standards.

  • Landscape contractors and subcontractors managing bids, schedules, and pricing for maintenance or construction projects.
  • Property owners, homeowners associations, and facility managers seeking consistent service levels and invoice predictability.
  • Commercial real estate managers and development teams coordinating multi-site pricing and contract standardization.

Signing parties are usually an authorized contractor representative and the property owner or an authorized facility manager; signatures should reflect authority to bind each organization.

Core Elements to Include in a Professional Agreement

A thorough Landscape Pricing Agreement breaks the project into clear components, pricing methods, timeline milestones, responsibilities, and remedies so performance and payments are measurable and enforceable.

Scope of Work

Describe specific services (mowing, pruning, fertilization, irrigation management, plant installation), including measurable deliverables, service frequencies, and any exclusions that affect price or timing.

Pricing Method

State whether pricing is lump-sum, unit-rate, time-and-materials, or cost-plus; include unit definitions (per square foot, per bed, per visit) and how overtime or additional labor is billed.

Schedule & Milestones

Include start and completion dates or recurring service windows, inspection points, seasonal schedule changes, and timeframes for responding to client requests or change orders.

Payment Terms

Specify invoice frequency, net terms (for example, Net 30), retainage (if any), late fees, acceptable payment methods, and requirements for liens or bond releases.

Change Orders

Define how additional work or reductions are documented, approved, and priced; require written change orders signed by both parties before commencing changed work.

Insurance & Liability

Identify required insurance coverage, proof of insurance, indemnity language, limits of liability, and responsibility for damage to property or third-party injuries.

Step-by-Step: How to Complete the Agreement

Follow these steps to prepare, confirm, and execute a Landscape Pricing Agreement to reduce mistakes and ensure enforceability.

  • 01
Draft Scope: List all tasks and frequencies.
  • 02
Calculate Prices: Apply unit rates or totals.
  • 03
Review Terms: Confirm insurance and liability clauses.
  • 04
Execute Signatures: Have authorized parties sign dated.

Configuring an Online Workflow for This Agreement

Set up a digital workflow that routes drafts, collects approvals, attaches exhibits, and preserves an audit trail for each signature event.

How Electronic Signing Works for This Agreement

Electronic execution follows a few consistent steps from sender to signed record; keep authentication and retention in mind for enforceability.

  • Upload and Tag: The sender uploads and places required fields.
  • Send to Signers: Signers receive email or link to review.
  • Authenticate: Signers confirm identity by chosen method.
  • Complete and Archive: Signed copies and audit logs are stored.

Technical and Platform Considerations for eSigning

Choose a platform that supports the file formats and authentication levels your organization requires and preserves a tamper-evident audit trail.

  • File Formats: PDF and DOCX supported.
  • Authentication: Email, SMS, KBA options.
  • Integrations: Connects to CRMs and cloud storage.

Key Timing Considerations and Deadlines

Track dates for contract start, seasonal milestones, invoice due dates, and any statutory retention or notice periods that affect remedies.

Contract Effective Date:

Date obligations begin and warranties compute from.

Service Windows:

Recurring dates for maintenance visits and seasonal tasks.

Invoice Due Dates:

Standard net terms such as Net 30 or Net 45.

Change Order Response:

Time allowed to approve or reject changes.

Termination Notice:

Notice period required to end services.

Common Errors That Cause Delays or Disputes

  • Vague scope descriptions that omit frequency or exact locations create disagreements about what work was expected.
  • Missing or incorrect legal names for parties make invoicing, insurance checks, and enforcement more difficult.
  • Unclear change order processes allow contractors to perform extra work without client approval, causing billing disputes.
  • Failing to require written approval for extra materials or subcontracted work leads to unexpected cost allocation problems.

Contract Risks and Consequences of Inaccuracies

Payment Delays: Invoices disputed and withheld.
Liability Exposure: Insurance gaps may leave one party uninsured.
Lien Risk: Contractor may file mechanic's lien.
Warranty Dispute: Ambiguous warranty periods cause claims.
Regulatory Noncompliance: Permit issues can halt work.
Enforceability: Improper signatures can render agreement void.
