What the Landscaping Arborvitae Installation document covers

A Landscaping Arborvitae Installation document is a written agreement that defines the scope, specifications, schedule, responsibilities, and payment terms for planting arborvitae (Thuja species) as a living screen or hedge. It typically includes plant size and species, spacing, site preparation, irrigation and soil amendments, access and utility coordination, acceptance criteria, warranty and maintenance obligations, change-order procedures, and indemnity or liability limits. The form functions as a performance contract between the property owner and contractor and can be used to obtain permits, document consent, and memorialize timing and payment milestones.

Why a formal installation agreement matters for arborvitae projects

A clear written agreement reduces disputes by documenting plant specifications, site conditions, responsibilities, schedules, and remedies. It protects both owner and contractor by aligning expectations on warranty, maintenance, access, and payment.

Essential clauses to include in the installation agreement

A professional installation agreement groups technical, commercial, and legal terms so obligations are clear and enforceable.

Scope of Work

Describe site preparation, excavation, grading, soil amendments, irrigation connections, and disposal of existing materials so both parties understand responsibilities and deliverables.

Plant Specifications

List botanical names, size or caliper at purchase, rootball/container type, and source nursery to avoid substitution disputes at delivery and planting.

Site Preparation

Specify access requirements, utility locates, root barriers, mulch depth, and irrigation tie-in responsibilities prior to planting.

Payment Terms

Include deposit amount, milestone payments, retainage if applicable, and acceptable payment methods to prevent billing disagreements.

Warranty and Replacement

State warranty duration, covered losses (e.g., nursery defects), replacement schedule, and conditions such as required maintenance by the owner.

Acceptance Criteria

Security and compliance considerations when storing signed agreements

HIPAA support: BAA available
Regulatory standards: ESIGN and UETA

Common preparation errors to avoid

  • Specifying vague plant descriptions such as 'mature' or 'standard' without botanical name and size leads to disputes over substitutions and quality.
  • Omitting site conditions — failing to document utilities, slope, or poor drainage — causes unexpected costs and warranty denials.
  • Not clarifying maintenance responsibilities and watering schedules can void warranty coverage and result in plant failure.
  • Using informal signatures or unsigned change orders creates ambiguity about authorized modifications and payment adjustments.

Risks and legal consequences of incomplete or incorrect agreements

Permit violations: Fines or stop-work orders
Wrong plant installed: Replacement costs and delays
Missing signatures: Agreement may be unenforceable
Incorrect legal name: Payment or lien issues
Unclear warranty terms: Disputes over replacements
