The holder of this note for collection, said holder shall be entitled to draw to for one third , except that the holder of the interest in the proceeds from the sale of the mobile home hereinafter described shall not be entitled to draw from the proceeds of sale for the payment of the interest until one year after the sale of the mobile home at which time the holder shall be entitled to draw and the proceeds of sale thereafter shall remain with the seller of said mobile home in trust and the principal amount of which interest shall thenceforth be held by the holder thereof in trust for the holder's sole use and advantage until the same is paid in full. In the event that the holder of the interest hereinafter described fails in carrying out the foregoing obligation or performs any act inconsistent with this agreement, the holder shall hold the unpaid interest in virtue of the deed to the land described herein as against the holder of the interest hereinafter described who has received title to any portion of the land herein described and the holder shall collect the unpaid interest in foreclosure proceedings thereon. In the event that the holder of the interest hereinafter described fails in carrying out the foregoing obligation or performs any act inconsistent with this agreement, the holder of the interest hereinafter described shall pay to the amount of the unpaid interest which has accrued hereunder for the prior 6 months, plus any additional interest which the holder may have accruing prior to the time of foreclosure proceedings. The holder of the interest hereinafter described shall cause the deed giving title to the land described herein as against the holder of the interest hereinafter described who has received title to any portion of the land herein described to be recorded in the proper office in favor of the holder of the interest hereinafter described, and such deed shall be recorded in accordance with section 1-205, subdivision 6 of the real property code and section 35 of the land use plan act, as the case may be.
