Lease Agreement or Rental of a Mobile Home This Lease Agreement is made is made effective the ____ day of ___________, 20___, between ________________________ Mobile Home Leasing, hereafter referred to a Owner, and ________________________, of ________________________________________________ (street address, city & state) hereafter referred to as Lessee. For and in consideration of the mutual covenants contained in this Lease, the parties agree as follows: 1. Description of Property Owner hereby leases to Lessee and Lessee leases from Owner the mobile home bearing Serial Number __________________ and being more particularly described as (put description of mobile home here) . 2. Term of Agreement The period of this lease is ______ months beginning on the ____ day of ____________, 20_____, and ending on the ______ day of ______________, 20____. 3. Rental Lessee agrees to pay as rental for the use of the mobile home the sum of _____________________________ Dollars ($___________) per month, the first payment to made at the time the mobile home is delivered to Lessee, and each subsequent payment to be made in advance on the first day of each subsequent month. 4. Payment for Propane and Gasoline The mobile home is being leased to Lessee with full tanks of propane and gasoline (high octane). In addition to the rental provided in Section 3, Lessee agrees to pay Owner for all such propane and gasoline used by Lessee. Lessee is to return the vehicle with the propane and gasoline tanks full or pay to Owner an amount equal to the cost of filling the same. 5. Insurance Owner agrees to maintain collision and comprehensive insurance for the mobile home with a ______________________________ Dollars deductible clause on collision coverage and a ___________________________________ Dollars deductible clause on comprehensive coverage. Lessee agrees to reimburse owner for the first ____________________________ Dollars collision damage and/or the first ___________________________ Dollars comprehensive damage. 6. Deposit Lessee agrees to deposit the sum of _______________________ Dollars with Owner, the receipt of which is hereby acknowledged, as assurance that the mobile home will be returned in the same clean condition as it is delivered to Lessee, the deposit to be refunded or applied to the mileage if the condition of the mobile home, upon its return, is acceptable to Owner. 7. Indemnification Lessee agrees to indemnify Owner for any and all claims resulting from, or incidental to, the operation of the mobile home during the term of this lease. Lessee assumes all risks and liabilities from the use and operation of the mobile home. 8. Warranties Owner is not the manufacturer of the mobile home and makes no warranty against patent or latent defects in material or workmanship of the mobile home. 9. Personal Items and Emergency Expenses Lessee assumes sole responsibility for any of Lessee = s personal items carried in the mobile home and for any emergency living expenses and expenses that might be incurred by lessee in the event of a mechanical failure of the mobile home. 10. Reports Lessee shall furnish Owner, within _________ hours after its occurrence, a complete report concerning any accident, collision, and damages to or involved with the mobile home, and, in the event of mechanical failure, shall immediately notify Owner of the failure. 11. Operation Manual Owner hereby delivers and Lessee hereby acknowledges receipt of the operation manual for the mobile home, and Lessee acknowledges that Lessee has personally inspected the mobile home and found it to be free of defects and in a clean condition, with all fuel tanks registering full. Lessee agrees to abide by all the rules and regulations of Owner as set forth in the operation manual furnished to Lessee. The contents of the operation manual are incorporated into and made a part of this Lease by reference. 12. Repairs Lessee shall be solely responsible for all mechanical repairs and replacements necessary or desirable due to lessee = s negligence or failure to operate the vehicle according to this Lease and the operation manual furnished Lessee. 13. Vehicle Code Violations Lessee shall be solely liable for all lines, penalties, and forfeitures imposed for parking, traffic or other vehicle code violations while the mobile home is in Lessee = s possession. 14. Return of Mobile Home Lessee agrees to return the mobile home to owner at (street address, city and state) on or before (time) , on the final date of this Lease. 15. Area of Use Lessee agrees not to remove the mobile home from the continental United States or the State of _______________________. 16. Rebuttal of Agency Neither Lessee nor any other operator of the mobile home shall be deemed to be the agent, servant, or employee of Owner for any reason or for any purpose. 17. Assignment This Lease is personal to Lessee and may not be assigned by Lessee. 18. Age of Operator The operation of the mobile home by any driver under age of 21 years of age is prohibited.
