What a Lease Agreement Is and when it applies

A Lease Agreement is a legally binding contract in which an owner (landlord) grants a tenant the right to occupy defined real property for a set term in exchange for rent and other obligations. In the United States leases cover residential and commercial tenancies and typically include parties, premises description, term, rent, security deposit, permitted uses, maintenance responsibilities, default remedies, and signature blocks. Electronic execution is generally enforceable under ESIGN (15 U.S.C. ch. 96) and UETA where adopted, provided intent, consent, attribution, and record retention are satisfied.

Why a clear Lease Agreement protects both parties

A concise lease clarifies rights, reduces disputes, and preserves remedies for breach under state landlord–tenant law.

Why a clear Lease Agreement protects both parties

Who completes and relies on Lease Agreements

Typical users include parties directly involved in occupancy and those who manage or advise on real estate transactions.

  • Landlords and property managers — Draft, deliver, and enforce lease terms for single or multi-unit portfolios; coordinate notices and collections.
  • Tenants and guarantors — Review payment obligations, move-in conditions, and maintenance responsibilities before signing to avoid future disputes.
  • Attorneys and paralegals — Review statutory compliance, customize clauses, and prepare exhibits, addenda, and eviction-ready documentation.

Tailor the form and execution method to the user's role and applicable state rules.

Step-by-step: completing and executing a Lease Agreement

Follow a consistent sequence to reduce omissions and speed execution when using digital tools.

  • 01
Prepare document: Upload template and attach exhibits like move-in checklist.
  • 02
Populate fields: Fill parties, term, rent, deposit, and special clauses.
  • 03
Set signing order: Assign signers and any witness or notarization steps.
  • 04
Execute and archive: Collect signatures, save PDF/A copy, and log audit trail.

Core provisions to include in a professional Lease Agreement

Ensure the lease includes basic and supplemental provisions that address occupancy, payment, liability, and end-of-term procedures.

Parties

Identify landlord, tenant, and any guarantors using legal names and entity types; include contact information and authorized signing representatives.

Premises

Describe the rented space precisely, include parking or storage rights, and reference attached exhibits or floor plans where needed.

Term

Specify start and end dates, renewal options, early termination conditions, and holdover rent rates where applicable.

Rent & Fees

State payment amount, due dates, accepted methods, late fees, returned-check charges, and any percentage-based increases or CPI adjustments.

Security & Deposits

Detail deposit amount, permitted uses, interest handling if required by state law, and timing for return after lease termination.

Maintenance & Repairs

Allocate responsibility for utilities, repairs, routine upkeep, and alterations; reference habitability standards and notice procedures.

Essential data fields and privacy considerations

Party Identifiers: Full legal names
Contact Details: Addresses and phone numbers
Payment Details: Bank or card info (secure handling)
SSN/TIN: Use only when legally required
Property Description: Street, unit, legal description
Emergency Contacts: Name and phone for tenant

How electronic lease signing and routing typically works

A standard e-signing workflow moves the document from preparation to signing and then to secure storage with audit data captured at each step.

  • Prepare: Upload and place fields for signatures, initials, and dates.
  • Send: Email or generate signing link for recipients.
  • Sign: Signers authenticate and complete required fields.
  • Archive: Automatically store PDF with audit trail and certificates.

Digital workflow settings to configure before sending a lease

Configure signer authentication, field behavior, and notifications to match the lease's risk profile and state requirements.

Field Configuration
Signature Type Electronic or notarized remote option
Authentication Email, SMS code, or knowledge-based KBA
Conditional Fields Show clauses only when applicable
Notifications Reminders, expirations, and receipts

Technical and integration considerations for eSigning leases

Choose a platform that supports required authentication, audit trails, file formats, and integrations with accounting or property management systems.

  • Integrations: Salesforce, NetSuite, Microsoft 365
  • File Formats: PDF, DOCX, HTML, Excel
  • Authentication: Email, SMS, KBA, SSO

Common timing and notice items to track in a lease

Track fixed dates and recurring deadlines to ensure compliance with rent cycles, notice periods, and deposit timelines.

Effective Date:

Start date that triggers tenant and landlord obligations

Rent Due Date:

Monthly or periodic date agreed in the lease

Notice to Renew/Terminate:

Typically 30–60 days before end of term

Security Deposit Return:

State-dependent timeframe for return after termination

Move-out Inspection:

Schedule within final tenancy days and document findings

Common mistakes when preparing a Lease Agreement

  • Using vague term language that leaves rent increases or renewal conditions open to interpretation, causing later disputes and potential tenant claims.
  • Failing to attach or reference required exhibits such as move-in checklists, lead paint disclosures, or HOA rules which are often legally required.
  • Mismatching party names or failing to identify entity signatories properly, which can invalidate enforcement or complicate eviction and collection actions.
  • Ignoring local rent control, habitability obligations, or security deposit limits that can result in statutory penalties and treble damages in some states.

Penalties and risks of an incorrect or incomplete lease

Invalid Notices: Improper service
Security Deposit Violations: Statutory fines
Eviction Delays: Procedural setbacks
Tenant Claims: Breach or habitability suits
Data Exposure: PII mishandling
Drafting Errors: Unenforceable clauses
