Applicant hereby authorizes Owner/Manager and their agents to obtain consumer credit reports, criminal history, eviction records, employment verification, income verification, rental history, and other consumer or investigative reports for the purpose of evaluating this Application. Applicant acknowledges that such reports may include public records and other information.

Applicant further certifies that all information provided in this Application is true, complete and correct. Applicant understands that any materially false or omitted information may be grounds for denial of the Application or for termination of any tenancy granted pursuant to a lease, and may subject Applicant to liability for damages.

Consent to Background and Credit Check: I consent to verification of the information provided and to release of applicable reports to Owner/Manager.

7. APPLICATION FEE AND HOLDING DEPOSIT

Applicant acknowledges payment of an application fee in the amount of which covers the cost of credit and background checks and is non-refundable except as required by law. Payment of a holding deposit, if accepted by Owner/Manager, shall be governed by separate written receipt and shall be applied to the first month's rent or refunded according to the terms of that receipt.

8. REPRESENTATIONS AND WARRANTIES

Applicant represents and warrants that Applicant has the authority to submit this Application and that there are no judgments, unpaid debts or undisclosed material liabilities that would impair Applicant's ability to perform under a lease. Applicant agrees to promptly notify Owner/Manager in writing of any change in any material information provided herein.

9. NOTICES

All notices under this Application shall be in writing and delivered to the addresses provided in this Application or to such other addresses as the parties may designate in writing. Notice shall be effective upon personal delivery, three days after deposit in the United States mail when sent by certified mail, or one business day after deposit with a nationally recognized overnight courier.

10. MISCELLANEOUS PROVISIONS

Governing Law: This Application and any resulting lease shall be governed by and construed in accordance with the laws of the state in which the Property is located, without regard to principles of conflicts of law.

Entire Agreement: This Application, when executed by Applicant and accepted by Owner/Manager, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, understandings and agreements.

Severability: If any provision of this Application is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

Amendments and Waiver: No amendment or waiver of any provision of this Application shall be effective unless in writing and signed by the party against whom enforcement is sought. Failure to enforce any provision shall not constitute a waiver of future enforcement.

Counterparts: This Application may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Signatures delivered by electronic transmission shall be binding.
