LEGAL ADULT RELEASE FORM

This Release Agreement (the "Agreement") is made on by and between Releasor Name: , an individual residing at (the "Releasor"), and Releasee Name: , with principal address (the "Releasee").

RECITALS

WHEREAS, Releasee operates, sponsors or supervises the activity described as: ; and

WHEREAS, Releasor desires to participate in the activity and acknowledges that participation may involve inherent risks and potential hazards; and

WHEREAS, Releasee requires completion of this Agreement as a condition to permitting participation in the described activity.

NOW, THEREFORE, in consideration of being permitted to participate and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. RELEASE AND WAIVER

Releasor, on behalf of Releasor and Releasor's heirs, executors, administrators, personal representatives, successors and assigns, hereby irrevocably releases, waives, discharges and covenants not to sue Releasee and its officers, directors, employees, agents, volunteers, affiliates and insurers (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, losses, damages, costs and expenses, whether known or unknown, foreseen or unforeseen, arising out of or related to Releasor's participation in the activity, including but not limited to claims for personal injury, property damage, wrongful death, economic loss or consequential damages, regardless of whether such claims arise from the negligence (active, passive or comparative), breach of contract, strict liability or other fault of any Released Party.

2. ASSUMPTION OF RISK

Releasor understands and acknowledges that participation in the activity carries certain inherent risks which may result in injury, illness, death, or damage to property. Releasor freely and voluntarily assumes all such risks, whether identified in this Agreement or not, and acknowledges that Releasor has had the opportunity to ask questions and obtain information about those risks.

3. INDEMNIFICATION

To the fullest extent permitted by law, Releasor agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, demands, liabilities, damages, losses, fines, penalties, costs and expenses (including reasonable attorneys' fees and costs of investigation) arising out of or resulting from Releasor's acts, omissions, or willful misconduct in connection with participation in the activity, or from Releasor's breach of any representation, warranty or obligation under this Agreement.

4. MEDICAL AUTHORIZATION; HEALTH REPRESENTATIONS

Releasor certifies that Releasor is physically fit and capable of participating in the activity. In the event of an emergency, Releasor authorizes Releasee and its representatives to obtain medical treatment for Releasor and to take such actions as may be reasonably necessary to protect Releasor's health and safety. Releasor agrees to be financially responsible for all medical expenses incurred on Releasor's behalf.

5. REPRESENTATIONS AND WARRANTIES

Releasor represents and warrants that Releasor is at least eighteen (18) years of age, is legally competent to execute this Agreement, and has not relied upon any statements or representations of any Released Party other than those expressly set forth herein. Releasor further represents that all information provided in this Agreement is true and correct.

6. MEDIA RELEASE (OPTIONAL)

Releasor hereby grants Releasee the unlimited, perpetual, royalty-free right to use Releasor's image, likeness, voice and statements in any photographs, digital images, video recordings, audio recordings, or other media taken or recorded during the activity for promotional, educational, advertising or other lawful purposes. Releasor waives any right to inspect or approve the finished product and any claims for compensation related thereto.

This Agreement shall be effective as of the date first written above and shall survive the completion of the activity. The release and indemnity provided herein apply to all claims arising out of any acts or omissions occurring prior to, during, or after the activity, whether such claims are asserted now or in the future.

This Agreement shall be governed by and construed in accordance with the laws of the state selected for governing law: . No amendment, modification or waiver of any provision of this Agreement shall be effective unless made in writing and signed by both parties. The failure of any party to enforce any provision of this Agreement shall not constitute a waiver of that provision or of the right to enforce it subsequently.

12. COUNTERPARTS

This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Signatures transmitted by electronic means shall be deemed to be original signatures for all purposes.

NOTICES

Any notice required or permitted hereunder shall be in writing and shall be delivered to the contact information supplied above or to such other address as either party may designate in writing. Notices shall be deemed given upon hand delivery or three (3) days after deposit in the United States mail, postage prepaid, certified or registered mail.
