LEGAL BAIL FORM

This Bail Agreement and Indemnity is made on this between Principal Name: (hereinafter "Principal") and Surety Name: (hereinafter "Surety"). Principal and Surety are collectively referred to as the "Parties."

RECITALS

WHEREAS, Principal is charged in the matter of under Case Number: in the ;

In consideration of the mutual covenants contained herein and other good and valuable consideration, the Parties agree as follows:

1. DEFINITIONS

For the purposes of this Agreement: "Bond" means the bail bond or undertaking executed by Surety to secure Principal's appearance; "Forfeiture" means the monetary obligation to the court resulting from Principal's failure to appear as required.

2. BAIL AMOUNT AND BOND

The Parties acknowledge that the court set bail in the amount of $ and that Surety will execute a Bond in that amount conditioned upon Principal's compliance with all terms and appearance obligations ordered by the court.

3. CONDITIONS OF RELEASE

Principal shall comply with all conditions imposed by the court, including but not limited to appearing at all hearings, submitting to supervision or electronic monitoring if ordered, and complying with any travel or reporting restrictions. Principal acknowledges that failure to comply will constitute default under this Agreement and permit Surety to exercise remedies set forth herein.

4. OBLIGATIONS OF PRINCIPAL

Principal warrants the truthfulness of all information provided to Surety and to the court and agrees to appear at all required proceedings. Principal grants consent to Surety to obtain criminal history and other relevant information necessary to effect and maintain the Bond.

5. INDEMNITY

Principal and any indemnitor jointly and severally agree to indemnify, defend, and hold harmless Surety from and against any and all liabilities, losses, costs, attorney's fees, fines, and expenses (including those arising from enforcement of this Agreement) incurred as a result of the issuance of the Bond or any breach by Principal, including payment of any Forfeiture to the court and any costs of locating or surrendering Principal.

6. REMEDIES AND FORFEITURE

If Principal fails to comply with the court's conditions or fails to appear, Surety may surrender Principal to custody or voluntarily pay the Forfeiture. Payment of the Forfeiture shall not preclude Surety from exercising any rights of recovery against Principal or any indemnitor, including the right to seek exoneration of the Bond when permitted by law.

7. SURRENDER AND RETURN OF COLLATERAL

Upon exoneration of the Bond or payment of all sums due under this Agreement, Surety shall release any collateral held by it, subject to satisfaction of claims and any lawful offsets for costs and attorney's fees incurred in enforcing this Agreement.

8. NOTICES

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses provided below by hand, certified mail, or nationally recognized courier service. Notice is effective upon receipt.

9. AMENDMENT AND WAIVER

This Agreement may be amended only by a written instrument signed by both Parties. No waiver of any default shall be effective unless in writing and signed by the Party granting the waiver; a waiver of one breach shall not be deemed a waiver of any other breach.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of without regard to conflict of laws principles.

11. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties with respect to its subject matter and supersedes all prior and contemporaneous understandings, representations, and agreements, whether written or oral.

12. SEVERABILITY

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

13. COUNTERPARTS

This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument.
