8. AMENDMENTS; WAIVER; COUNTERPARTS

No amendment to this Declaration shall be effective unless in writing and signed by both parties. Waiver of any provision or breach shall not be construed as a waiver of any other provision or subsequent breach. This Declaration may be executed in counterparts, each of which shall be an original and all of which together shall constitute one and the same instrument.
