LEGAL BODILY INJURY RELEASE FORM

This Bodily Injury Release and Settlement Agreement (the "Release") is made and entered into as of Effective Date: by and between Releasor Name: of ("Releasor"), and Releasee Name: of ("Releasee").

RECITALS

WHEREAS, on or about Incident Date: at or near Location: , Releasor sustained bodily injury arising out of or related to the incident described below;

WHEREAS, the parties desire to settle and resolve any and all claims, demands, causes of action and liabilities arising from or related to the incident without the expense and uncertainty of litigation; and

WHEREAS, as a material inducement to entering into this Release, Releasee has agreed to provide consideration as set forth below.

NOW, THEREFORE

In consideration of the mutual covenants and promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. DEFINITIONS

For purposes of this Release, the following terms shall have the meanings set forth below: "Claims" means any and all manner of actions, causes of action, suits, debts, liabilities, obligations, demands, losses, costs, expenses, attorneys' fees, and damages, whether known or unknown, suspected or unsuspected, direct or consequential, which arise out of or relate to the Incident described above.

Releasor, for Releasor and Releasor's heirs, executors, administrators, successors and assigns, hereby fully, finally and forever releases, discharges, and covenants not to sue Releasee and Releasee's past, present and future owners, officers, directors, employees, agents, insurers, attorneys, affiliates and assigns (collectively, the "Released Parties") from any and all Claims, whether known or unknown, asserted or unasserted, arising out of or in any way connected with the Incident, including but not limited to claims for personal injury, emotional distress, medical expenses, lost wages, and wrongful death.

4. SCOPE OF RELEASE

The release herein is intended to be as broad and inclusive as permitted by applicable law. Releasor expressly waives the benefit of any statute or common law principle that would otherwise limit the extent of the release, including but not limited to statutes or doctrines concerning unknown claims or subsequent discovered injuries.

5. CONSIDERATION

In exchange for the promises made in this Release, Releasee agrees to pay Releasor the sum of (the "Consideration"), subject to any applicable withholdings and conditions identified in this Agreement. Receipt of the Consideration is acknowledged and accepted as adequate and fair consideration for the Release set forth herein.

6. NO ADMISSION OF LIABILITY

The parties acknowledge and agree that this Release and the payment of the Consideration are not and shall not be construed as an admission of liability, fault, or wrongdoing by any Released Party, all such liability being expressly denied.

7. REPRESENTATIONS, WARRANTIES AND AUTHORITY

Releasor represents and warrants that Releasor has the full right, power, legal capacity and authority to execute and deliver this Release and to perform its obligations hereunder; that Releasor has not assigned, transferred or conveyed to any person or entity any right, claim or cause of action released herein; and that Releasor has read and understands the terms of this Release.

8. ASSUMPTION OF RISK AND MEDICAL MATTERS

Releasor acknowledges and agrees that Releasor has sought and obtained or had the opportunity to seek independent medical evaluation and treatment for the injuries described herein. Releasor assumes all risks of future complications or delayed manifestation of injuries related to the Incident. Releasor authorizes Releasee to obtain medical records related to the Incident as necessary to effectuate this Agreement and further agrees to fully cooperate with any such reasonable requests.

9. INDEMNIFICATION

Releasor agrees to indemnify, defend and hold harmless the Released Parties from and against any loss, liability, damage, cost or expense (including reasonable attorneys' fees) arising out of any breach of Releasor's representations, warranties, covenants or obligations under this Release.

10. NO FURTHER CLAIMS

Releasor covenants and agrees that Releasor will not now or in the future institute any suit, action or administrative proceeding against any Released Party on account of any matter released by this Release. Any attempt to pursue such claims shall be barred by this Release and may be subject to dismissal and recovery of attorneys' fees by the prevailing Released Party.

11. CONFIDENTIALITY

Unless prohibited by law, the parties agree to keep the terms and amount of this settlement confidential and not to disclose such information to any person or entity, except as may be required by law, court order, or to enforce the terms of this Release, or as reasonably necessary to obtain tax, accounting or legal advice.

12. NOTICES

Notices shall be deemed delivered upon personal delivery, or three (3) business days after deposit in the United States mail, postage prepaid, certified mail, return receipt requested, or upon confirmed delivery via nationally recognized overnight courier, to the addresses provided above or to such other address as a party may designate in writing.

13. GOVERNING LAW

This Release shall be governed by and construed in accordance with the laws of the State of without regard to principles of conflicts of law.

14. ENTIRE AGREEMENT; SEVERABILITY

This Release constitutes the entire agreement and understanding between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, whether oral or written. If any provision of this Release is held to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.

15. AMENDMENTS; WAIVER; COUNTERPARTS

This Release may be amended or modified only by a written instrument executed by both parties. No waiver by any party of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default. This Release may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument. Facsimile or electronic signatures shall be binding for all purposes.

16. ADDITIONAL ACKNOWLEDGMENTS

Releasor acknowledges that Releasor has been advised to consult with independent legal counsel prior to executing this Release, that Releasor has read and fully understands the terms and consequences of this Release, and that Releasor signs this Release voluntarily and with full knowledge of its significance.
