What the Legal Consent to Change Attorney Is

The Legal Consent to Change Attorney is a formal, signed document by which a client authorizes substitution or discharge of one attorney and the substitution of another attorney of record. It records the client’s clear instruction, confirms the existing attorney has been informed or relieved as required, and provides contact and docket information for the incoming counsel. The form is typically filed with the court or exchanged with the opposing party in matters where substitution of counsel affects service, deadlines, or the official case record.

Why a Clear Consent Letter Matters

A written consent avoids confusion about representation, preserves the client’s choice, and creates a trail for court clerks and opposing counsel.

Why a Clear Consent Letter Matters

Who Prepares and Signs This Consent

Typical participants include the client, the outgoing attorney, and the incoming attorney named on the substitution.

  • Clients who wish to change legal representation and document their choice formally for the docket.
  • Outgoing attorneys when consenting to withdrawal or confirming they have provided file transfer and notice.
  • Incoming attorneys who accept representation and need an official record to receive service and notices.

In contested matters, the court or opposing counsel may also require a filed substitution form before accepting service on the new attorney.

Step-by-step: Completing the Consent to Change Attorney

Follow a consistent sequence: confirm consent, complete identifying details, obtain signatures, and submit the form according to court or party rules.

  • 01
Confirm Consent: Verify the client authorizes the change in writing.
  • 02
Identify Parties: Enter full names, firm names, and party roles.
  • 03
Signatures: Collect client and both attorneys’ signatures and dates.
  • 04
File or Serve: File with the court or serve opposing counsel per local rules.

Docket number and case caption appearing exactly as on court records to avoid clerical discrepancies and ensure proper indexing.

Client Authorization

A concise statement by the client consenting to the change, signed and dated to establish the client’s intent and effective date.

Data points to capture on the form

Bar Numbers: Outgoing and incoming
Contact Info: Phone and email

Signature Dates: Execution dates

Risks and consequences of an incorrect consent

Rejected Filing: May be refused
Missed Notices: Service failures
Delayed Deadlines: Court timelines affected
Ethics Complaints: If duties neglected
Evidence Gaps: Unclear record
Client Confusion: Representation unclear

Common mistakes to avoid when preparing the form

  • Using informal names or initials instead of the client’s full legal name can prevent the court from linking the consent to the correct case.
  • Omitting bar numbers or contact details for incoming counsel often results in clerk requests and delays in accepting the substitution.
  • Failing to obtain the client’s written signature or relying on email consent without an audit trail can create disputes about authority.
  • Not following local filing or service rules — for example, failing to serve opposing counsel or to file the substitution with the clerk — can nullify the substitution.

How electronic completion and submission typically works

Digital workflows mirror the paper process: prepare the form, collect signatures, and route the signed record for filing or service.

  • Prepare Document: Upload a PDF or template to a signing platform.
  • Place Fields: Add signature, date, and text fields where required.
  • Collect Signatures: Obtain client and attorneys’ signatures electronically.
  • Download & File: Save final PDF and file per court/party rules.

Configuring an online substitution workflow

A clear workflow reduces signer friction and ensures the signed form is ready for court upload or service.

Step / Setting Configuration
Signer Order Client first, then outgoing, then incoming
Authentication Email link or SMS code
Field Validation Require docket and bar numbers
Retention Store audit trail with PDF

Digital submission considerations for courts and parties

Confirm that the digital format and authentication level meet the receiving court’s or opposing counsel’s requirements before submission.

  • File Formats: PDF/A preferred by many courts
