6. NOTICES

All notices and communications required or permitted under this Declaration shall be in writing and delivered to the addresses set forth below or to such other address as a party may designate in writing.

7. AMENDMENT; WAIVER

No amendment, modification, or waiver of any provision of this Declaration shall be effective unless made in a written instrument signed by both parties. No failure or delay by a party in exercising any right hereunder shall operate as a waiver of that right.

8. GOVERNING LAW; SEVERABILITY; ENTIRE AGREEMENT

This Declaration shall be governed by and construed in accordance with the laws of the jurisdiction specified below without regard to conflict of laws principles:

If any provision of this Declaration is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
