What the Legal Description Form Is and Why It Exists

Legal Description Form is a standardized document that records the precise legal description of a parcel of real property for use in deeds, mortgages, plats, and title records. It translates survey data into a formal legal narrative—metes and bounds descriptions, lot and block references, or government survey coordinates—so public records, title companies, and local recording offices can identify the parcel without ambiguity. Accurate legal descriptions reduce boundary disputes, support clear title transfers, and are required by county recorder offices and title insurers when preparing recorded instruments.

Why Precision in the Legal Description Form Matters

An accurate Legal Description Form ensures property is uniquely identified in public records, prevents title defects, and enables correct tax and mortgage processing. It minimizes recording errors, expedites closings, and reduces the risk of costly boundary disputes or title insurance exceptions.

Why Precision in the Legal Description Form Matters

Who Prepares and Relies on the Form

Typical parties who prepare or rely on a Legal Description Form include title officers, surveyors, real estate attorneys, lenders, and county recorders.

  • Title companies: confirm description matches recorded plat and underwriting requirements to issue clear title.
  • Surveyors: produce metes-and-bounds or coordinate data and certify boundaries for recording.
  • Lenders and underwriters: require exact parcel identification to secure collateral and avoid exceptions.

Accurate preparation aligns stakeholder expectations and reduces back-and-forth during closing, underwriting, and recording.

Core elements of a professional Legal Description Form

A professional Legal Description Form organizes parcel identifiers, survey references, descriptive narrative, map citations, recording metadata, and signature/acknowledgement blocks for reliable recording and title use.

Parcel ID

Include official assessor parcel number (APN) or tax parcel number as recorded by the county; mismatches with the legal description can block recording or raise tax processing issues.

Metes & Bounds

Provide bearings, distances, and monuments in conventional metes-and-bounds format; reference the surveyor’s certificate, recorded plat or control points, and datum to ensure precise retracement and title consistency.

Lot/Block

If property is platted, cite lot, block, subdivision name, and recording information (book and page or instrument number) to match county plat records exactly there.

Reference Maps

Include a legal map reference, page or map book citation, and a reduced sketch showing bearings and dimensions to assist clerks and title examiners in visual verification.

Recording Data

Record date, county recorder instrument number, and prior deed references; this metadata ties the description to the recorded chain of title and eases future searches.

Acknowledgement

Include signature blocks, notary acknowledgement language per state law, and witness lines where required so the instrument satisfies local recording and county registrar formatting requirements.

Consequences of inaccurate or incomplete legal descriptions

Boundary Disputes: Litigation or survey costs.
Tax Assessment Errors: Incorrect tax bills issued.
Lien Priority: Mortgage priority may be affected.
Closing Delays: Lenders may withhold funding.

Common preparation errors to avoid

  • Transcribing the legal description with typographical changes or line breaks that alter bearings or distances can render the description ambiguous and cause recording rejection or title exceptions.
  • Using colloquial property references or street addresses instead of the formal recorded description creates ambiguity; addresses are not substitutes for legal descriptions.
  • Omitting the surveyor’s datum, control points, or recorded plat citation prevents accurate retracement and can lead to boundary disputes during title examination.
  • Failing to include the county recorder instrument number or prior deed references breaks the chain of title and complicates title searches and ownership verification.

Essential data elements required on the form

Legal Narrative: Full metes-and-bounds or lot-block.
Assessor Parcel: APN or tax parcel number.
Survey Citation: Recorded plat book and page.
Map Exhibit: Scaled sketch or survey PDF.
Recording Info: Instrument number, book, page.
