3. LIMITATION OF LIABILITY

7.1 Each party shall protect the other's Confidential Information with the same degree of care it uses to protect its own confidential information, but in no event less than reasonable care. Confidential Information shall not include information that is publicly known, rightfully received from a third party without restriction, or independently developed without use of the other party's Confidential Information.
