LEGAL FITNESS WAIVER

This Legal Fitness Waiver (the "Waiver") is entered into as of by and between Provider Name: with Principal Address: and Participant Name: Participant Address:

RECITALS

WHEREAS, Provider operates certain programs, facilities, services, or engagements for which the physical, mental and legal fitness of participants is material to safe and lawful participation; and

WHEREAS, Participant desires to engage in or participate in activities, services, employment, or programs provided by Provider and represents that Participant meets all legal, regulatory and medical qualifications required to participate; and

WHEREAS, Provider requires Participant to acknowledge certain risks, make specific representations and provide an indemnity and waiver of claims as a condition to participation.

NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. DEFINITIONS

1.1 "Activities" means all activities, services, programs, engagements, training, instruction, and events provided or supervised by Provider in which Participant may participate.

1.2 "Claims" means any demands, suits, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to Participant's participation in Activities.

2. REPRESENTATIONS AND WARRANTIES

Participant represents and warrants to Provider as of the Effective Date and for the duration of participation that:

a) Participant is at least eighteen (18) years of age, or if under 18, has provided appropriate parental or guardian consent as required by law. Participant Date of Birth:

b) Participant is physically and mentally able to participate in the Activities and has disclosed to Provider any material medical condition, medication, limitation or impairment that could affect safe participation. Medical disclosure provided:

c) Participant is not subject to any court order, professional suspension, license revocation, legal restriction, or criminal conviction that would legally or practically prohibit participation in the Activities. If any such restriction exists, Participant has provided details to Provider:

3. ASSUMPTION OF RISK

Participant acknowledges that participation in the Activities involves inherent risks, including but not limited to personal injury, disability, death, or property damage. Participant voluntarily assumes all risks associated with participation, whether those risks are known or unknown, foreseeable or unforeseeable, unless resulting from Provider's gross negligence or willful misconduct.

4. RELEASE AND WAIVER

To the fullest extent permitted by law, Participant hereby releases, waives, discharges and covenants not to sue Provider, its officers, directors, employees, agents, contractors and affiliates (collectively, the "Released Parties") from any and all Claims arising out of or relating to Participant's participation in the Activities, including Claims arising from the ordinary negligence of the Released Parties. This release does not extend to Claims arising from the gross negligence or willful misconduct of the Released Parties to the extent such Claims cannot be waived under applicable law.

5. INDEMNIFICATION

Participant shall indemnify, defend and hold harmless the Released Parties from and against any and all Claims, including reasonable attorneys' fees and costs, arising out of or resulting from Participant's acts or omissions, breach of this Waiver, misrepresentation, or failure to comply with Provider's rules and directions.

6. MEDICAL AUTHORIZATION

In the event of injury or medical emergency, Participant authorizes Provider to obtain or provide emergency medical treatment and agrees to be responsible for all costs incurred. Participant hereby consents to the release of any relevant medical information to medical personnel as may be necessary to provide treatment.

7. COMPLIANCE WITH LAWS AND RULES

Participant agrees to comply with all applicable laws, regulations and Provider rules while participating in Activities. Provider may, in its sole discretion, remove or exclude Participant from Activities for noncompliance or conduct that threatens safety or order.

8. NOTICE AND CONTACT

All notices under this Waiver shall be in writing and delivered to the addresses provided above by hand, courier, or certified mail, and shall be effective upon receipt.

9. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the jurisdiction selected by Provider: , without regard to conflict of laws principles.

10. ENTIRE AGREEMENT; SEVERABILITY

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings. If any provision of this Waiver is held invalid or unenforceable, the remainder of this Waiver shall remain in full force and effect.

11. AMENDMENT; WAIVER; COUNTERPARTS

No amendment or waiver of any provision of this Waiver shall be effective unless in writing and signed by both parties. No failure or delay by a party in exercising any right shall operate as a waiver. This Waiver may be executed in counterparts, each of which shall be deemed an original.

12. ACKNOWLEDGMENT
