LEGAL FORAGING WAIVER

This Legal Foraging Waiver (the Agreement) is entered into as of by and between Participant Name: and Organizer/Landowner Name: .

RECITALS

WHEREAS, Organizer controls or has lawful permission to permit access to the land and resources identified for the organized foraging activity and has agreed to allow Participant limited access for the purpose of harvesting wild edibles, botanicals, fungi, and other natural materials (Foraging Activities); and

WHEREAS, Participant desires to participate in Foraging Activities and acknowledges that foraging involves physical exertion, environmental hazards, risks of misidentification of specimens, and other inherent risks; and

WHEREAS, the parties intend by this Agreement to allocate risk and to establish Participant's assumptions of risk, release of claims, and obligations to indemnify Organizer and others.

NOW, THEREFORE

In consideration of the mutual covenants and conditions set forth herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. DEFINITIONS

For purposes of this Agreement, the following terms have the meanings set forth below:

"Foraging Activities" means all on-site activities related to locating, identifying, collecting, and transporting wild flora, fungi, and other natural materials, including preparatory instruction and guided walks.

2. ASSUMPTION OF RISK

Participant acknowledges that Foraging Activities present inherent risks including, but not limited to, personal injury, allergic reaction, food-borne illness from misidentified specimens, encounters with wildlife, uneven or slippery terrain, exposure to weather, and other natural or man-made hazards. Participant voluntarily assumes all risks, whether known or unknown, foreseen or unforeseen, arising from or related to Participant's participation in Foraging Activities.

3. RELEASE AND WAIVER OF LIABILITY

Participant, on behalf of Participant and Participant's heirs, executors, administrators, agents, assigns, and legal representatives, hereby fully releases, waives, discharges and covenants not to sue Organizer, Organizer's agents, employees, volunteers, landowners providing access, successors and assigns (collectively Released Parties) from any and all liability, claims, demands, actions and causes of action whatsoever, whether arising in tort, contract, statute or otherwise, for any loss, injury, illness, death or damage to property that may be sustained by Participant arising out of, related to, or resulting from Participant's engagement in Foraging Activities, including claims alleging negligence by any Released Party.

4. INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of or resulting from Participant's negligent, reckless or intentional acts or omissions in connection with Foraging Activities, including failure to follow instructions, collection of prohibited or protected species, or distribution of harvested materials to third parties.

5. REPRESENTATIONS AND WARRANTIES

Participant represents and warrants that Participant is at least eighteen (18) years of age, or that a parent or legal guardian has executed this Agreement on Participant's behalf where allowed by law; that Participant is physically fit and capable of participating in Foraging Activities; and that Participant has disclosed any medical conditions, allergies, or medications that could affect participation.

6. SAFETY, IDENTIFICATION AND HARVESTING PRACTICES

Participant shall follow all safety protocols, instructions, and site restrictions provided by Organizer or posted at the site. Participant acknowledges that identification of wild species is the sole responsibility of Participant and agrees not to consume or distribute any specimen unless Participant is certain of its identification. Participant agrees to use reasonable care when harvesting to avoid damaging habitat and to comply with any applicable seasonal, permit, or quota restrictions.

7. PROPERTY ACCESS; PERMITTED AREAS

Access to the land for Foraging Activities is limited to areas and routes expressly designated by Organizer. Participant shall not enter restricted, posted, or otherwise prohibited areas. Organizer reserves the right to revoke access at any time for Participant's failure to comply with this Agreement or site rules.

8. PROHIBITED CONDUCT

Participant shall not use vehicles off-road, build fires outside permitted locations, use chemical agents to extract specimens, or remove property not explicitly permitted by Organizer. Participant shall not collect specimens for commercial sale without prior written consent of Organizer and any landowners with an interest in the resources.

9. MEDICAL TREATMENT

In the event of an injury or medical emergency, Participant consents to receive reasonable emergency medical treatment and agrees to be financially responsible for all costs associated with such treatment. Participant authorizes Organizer and its representatives to secure emergency medical care as they deem appropriate.

10. INSURANCE

Participant acknowledges that Organizer does not carry medical or other insurance for Participant. Participant is encouraged to obtain appropriate personal insurance coverage. Participant's recovery for losses or injuries shall be limited to claims available under the law and subject to Participant's release and indemnity obligations herein.

11. NOTICES

Any notice required or permitted under this Agreement must be in writing and delivered to the other party at the address provided below or by email if an address is supplied on a separate acknowledgement. Notice shall be effective upon personal delivery, or three (3) days after deposit in the U.S. mail, postage prepaid, or upon confirmation of delivery if sent by commercial courier.

12. AMENDMENTS; WAIVER; COUNTERPARTS

This Agreement may be amended only by a writing signed by both parties. No failure or delay by Organizer in exercising any right shall operate as a waiver of that right. This Agreement may be executed in counterparts and by electronic or facsimile signature, each of which shall be an original but all of which together will constitute one and the same instrument.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the substantive laws of the state indicated below without regard to that state's conflict of laws principles.

14. ENTIRE AGREEMENT; SEVERABILITY

This Agreement constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior agreements and understandings, whether written or oral. If any provision of this Agreement is held to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect and the invalid provision shall be reformed to the maximum extent permitted by law to effect the parties' intent.

15. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges having read this Agreement, understands its terms, and agrees that Participant is giving up substantial legal rights by signing it, including the right to sue the Released Parties. Participant signs this Agreement freely and voluntarily.
