What a Legal Interview Recording Request Is

A Legal Interview Recording Request is a formal written authorization used to schedule, document, and obtain consent for recording interviews, witness statements, or depositions in legal matters. The form identifies parties, states the recording format and purpose, records consent or objection, specifies retention and access controls, and documents authentication and signature details. It helps create a clear chain of custody and an audit trail for admissibility, privacy compliance, and later review by counsel, investigators, or courts while preserving the recording’s metadata and provenance.

Why documenting consent and recording details matters

A clear recording request reduces disputes over consent, supports chain-of-custody evidence, and documents procedural safeguards required by ESIGN/UETA and applicable privacy laws. Precise records protect interviewers and subjects and improve admissibility and defensibility in litigation or regulatory review.

Why documenting consent and recording details matters

Who typically prepares and signs these requests

The Legal Interview Recording Request is used by attorneys, investigators, HR professionals, and compliance officers when interviews are recorded for legal or administrative purposes.

  • Civil litigation counsel and paralegals ensuring witness consent and metadata are captured for discovery
  • Internal investigators and HR teams documenting employee interview consent during workplace investigations
  • Government investigators and agency attorneys preserving official interview records for evidentiary use

Use of the form varies by role and industry; the completed request should be retained with the recording and case file to preserve legal and procedural context.

Primary signatories and their roles

Lead Attorney

Signs to authorize legal interview recordings on behalf of the client, confirms chain-of-custody procedures, and documents how the recording will be used in litigation or settlement negotiations.

Interview Subject

Signs to confirm informed consent or to record objection; their signature verifies identity, acceptance of the recording method, and understanding of retention and disclosure limits.

Essential security and compliance elements

Encryption: AES-256 at rest
Transport Security: TLS 1.2/1.3 in transit
Access Controls: Role-based permissions
Audit Trail: Timestamps and IPs
HIPAA Support: BAA available
Retention Controls: Tamper-evident storage

Key legal risks if the request is incorrect

Admissibility Risk: Loss of evidentiary value
Privacy Violation: HIPAA or FERPA exposure
Contractual Breach: Noncompliance with agreements
Regulatory Penalty: Agency fines possible
Criminal Exposure: Wiretapping statutes risk
Discovery Sanctions: Court-imposed sanctions

Common preparation mistakes to avoid

  • Failing to state the recording format and retention period, which complicates preservation and playback in discovery.
  • Using vague consent language that omits whether the recording includes audio, video, or screen capture, leading to disputes.
  • Not documenting signer identity or authentication method, which weakens attribution and creates admissibility challenges.
  • Omitting instructions for secure transfer and storage, raising chain-of-custody and data-breach exposure concerns.

Step-by-step: complete a Legal Interview Recording Request

Follow a consistent sequence to capture consent, identity, format, retention, and signature details so the recording is admissible and auditable.

  • 01
Identify Parties: Enter full legal names and roles for interviewer and subject.
  • 02
Describe Recording: Specify audio, video, screen capture, and file format.
  • 03
Set Retention: State retention period and access restrictions.
  • 04
Obtain Signatures: Collect signatures and record authentication details.

Where to send or file the completed request

Route the signed request to the case file, the evidence manager, and any authorized third parties following your internal records policy.

  • Case File: Store with the matter’s electronic folder and transcript.
  • Evidence Manager: Submit to the custodian of recordings for preservation.
  • Opposing Counsel: Produce under discovery if required.
  • Regulatory Agency: Provide when compelled by subpoena or regulation.

Core components to include in a professional request

A complete request balances clarity and legal precision: identify parties, describe recording details, secure consent, define retention, and record authentication and distribution parameters.

Header

Case identifier, matter name, date, and location. The header links the recording to a precise legal matter and should match case management entries to preserve chain of custody and searchability.

Parties

Full legal names, titles, and contact details for interviewer, subject, and any observer. Accurate identity fields avoid later disputes over who authorized or participated in the recording.

Recording Details

Specify audio/video/screen, file type, codec, start/stop times, and device identifiers. Technical clarity ensures the recording is playable and admissible without ambiguity about manipulation or loss.

Consent Statement

Plain-language consent describing uses, disclosures, and whether the interview can be used in court or shared with third parties; include an ESIGN-style electronic consent clause for e-signatures.

Retention & Access

Define retention period, secure storage location, access roles, and deletion procedure. Link retention to legal bases such as HIPAA, IRS, or agency rules where relevant.

Authentication

Signature block, signer authentication method, and audit trail requirements. Include signer email, IP address capture, and timestamping to support attribution under ESIGN and UETA.

How to configure an online recording workflow

Set authentication, field rules, storage, and audit capturing before sending the request to ensure legal and technical completeness.

Field Configuration
Authentication Email link or SMS OTP
Retention Encrypted storage, AES-256
Recording Format MP4 video or WAV audio
Audit Trail Capture IP, timestamp, signer actions

Technical and integration considerations

Confirm supported file types, integrations, and authentication options before collecting signatures to avoid workflow interruptions.

  • File Formats: PDF, MP4, WAV, DOCX
  • Integrations: Salesforce, NetSuite, Microsoft 365
  • Authentication: Email, SMS, SSO

Verify your platform preserves metadata, stores recordings securely with AES-256, and exports audit logs for discovery and compliance purposes.

Timing and deadlines to plan for

Be mindful of retention, discovery, and regulatory deadlines; include preservation instructions where litigation or agency review is possible.

Interview Scheduling:

Request permission and schedule before the interview date.

Retention Trigger:

Retention period begins on interview date.

HIPAA Minimum:

Retain 6 years per 45 CFR §164.530(j) when HIPAA applies.

I-9 Requirement:

I-9 related records: 3 years after hire or one year after termination.

Discovery Hold:

Implement immediate hold when litigation is reasonably anticipated.

Practical examples of common uses

Two typical scenarios illustrate practical template use across legal and internal investigations.

Civil Deposition

A plaintiff’s counsel schedules a recorded deposition to preserve testimony

  • Short technical note: video and transcript captured
  • The completed request ties the recording to the case number, records consent, and directs secure storage with audit logs for discovery.

Workplace Interview

An HR investigator records an employee interview after obtaining consent

  • Short technical note: audio-only, MP3 file retained
  • The request documents consent, retention timeline, and who may access the recording for internal review.
