LEGAL LIABILITY WAIVER

This Legal Liability Waiver (the "Waiver") is made effective as of by and between Participant Name: of Address: (hereinafter "Participant" or "Releasor"), and Releasee Name: of Address: (hereinafter "Releasee").

RECITALS

WHEREAS, Participant desires to engage in or participate in certain activities, events, programs, or services described as: (the "Activity");

WHEREAS, Releasee organizes, operates, sponsors, or provides facilities or supervision for the Activity and requires execution of this Waiver as a condition to participation; and

WHEREAS, Participant acknowledges that the Activity involves inherent risks and agrees to assume those risks and to release Releasee from liability as set forth below.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. DEFINITIONS

For purposes of this Waiver, the following definitions apply: "Activity" means the event, program, training, use of premises, or services described above; "Releasees" means Releasee and its officers, directors, employees, agents, volunteers, contractors, successors and assigns.

2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

Participant acknowledges and agrees that participation in the Activity includes risks that may result in property damage, personal injury, permanent disability, or death. Participant expressly assumes and accepts all such risks, whether known or unknown, inherent or incidental.

Participant confirms that to the best of Participant's knowledge Participant is physically, mentally, and medically able to participate and that Participant will comply with all instructions, warnings and rules provided by Releasee. Participant agrees to discontinue participation if Participant's condition or the conditions of the Activity become unsafe.

3. WAIVER AND RELEASE OF LIABILITY

Participant, on behalf of Participant and Participant's heirs, executors, administrators, legal representatives, successors and assigns, hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Releasees for any and all liability, claims, demands, actions or causes of action for personal injury, death, property loss or damage, whether caused by the negligence of Releasees or otherwise, arising out of or related to Participant's participation in the Activity, to the fullest extent permitted by applicable law.

4. INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Releasees from and against any and all claims, demands, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees and court costs) arising out of or related to Participant's acts or omissions, breach of this Waiver, or participation in the Activity.

5. MEDICAL TREATMENT AND EMERGENCY AUTHORIZATION

Participant authorizes Releasee to obtain emergency medical treatment for Participant if Releasee reasonably believes such treatment is necessary. Participant agrees to be responsible for and indemnify Releasee for all costs and expenses related to such medical treatment.

6. REPRESENTATIONS AND WARRANTIES

Participant represents and warrants that Participant is at least 18 years of age and has the full power and authority to enter into this Waiver. If Participant is under the age of 18, a parent or legal guardian must execute the Waiver on Participant's behalf and thereby acknowledge and assume the obligations herein.

Participant further represents that Participant has disclosed all medical conditions, medications, allergies, or other circumstances that could affect Participant's safe participation in the Activity:

7. INSURANCE

Participant understands that Releasee may not carry medical or disability insurance covering Participant and that Participant is encouraged to obtain appropriate coverage. Participant acknowledges that Participant is responsible for any medical expenses incurred as a result of participation in the Activity.

8. CONFIDENTIALITY AND PHOTOGRAPHY

Participant grants Releasee the right to take and use photographs, audio or video recordings of Participant in connection with the Activity for promotional, educational and commercial purposes without further consent or compensation, subject to any limitations described below:

9. NOTICES

All notices or other communications required or permitted under this Waiver shall be in writing and delivered to the addresses set forth above or to such other address as either party may designate in writing.

10. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the state or jurisdiction where the Releasee's principal place of business is located, without regard to conflict of law principles. Any claim or cause of action arising under this Waiver shall be brought exclusively in the state or federal courts located in that jurisdiction.

11. ENTIRE AGREEMENT; SEVERABILITY

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings. If any provision of this Waiver is held to be invalid or unenforceable, the remainder of the Waiver shall continue in full force and effect.

12. AMENDMENTS; WAIVER; COUNTERPARTS

No amendment or waiver of any provision of this Waiver shall be effective unless in writing and signed by both parties. Failure to enforce any provision shall not constitute a waiver of future enforcement. This Waiver may be executed in counterparts and by electronic signature, each of which shall be deemed an original and all of which together shall constitute one instrument.

By signing below, Participant acknowledges that Participant has read this Waiver in its entirety, understands its terms, has had the opportunity to ask questions and seek independent legal advice, and agrees to be bound by its terms.
