What the Legal Notice of Representation Is and When it Applies

A Legal Notice of Representation formally informs third parties, courts, opposing counsel, or administrative bodies that a named attorney or law firm represents a specific client in a legal matter. The notice identifies the client, the attorney or firm, relevant case or matter identifiers, and contact information for future communications. It is used to direct service, centralize communications, and record who is authorized to receive confidential or privileged material on the client’s behalf. The notice is typically delivered when representation begins, changes, or ends.

Why a Clear Notice Matters for Case Management and Compliance

Issuing a timely Notice of Representation avoids duplicate service, preserves privilege, and ensures official notices reach counsel. It creates a documented chain of contact that courts and agencies rely on for procedural communications.

Why a Clear Notice Matters for Case Management and Compliance

Who Issues and Receives These Notices

Use the notice to centralize communications, update case dockets, and protect privilege by ensuring counsel receives privileged materials.

  • Law firms and solo practitioners who have accepted a new matter and need official routing for legal notices and service.
  • In-house counsel and corporate legal departments notifying opposing counsel and vendors about authorized representatives.
  • Clerks, agency case managers, and court administrators who must update their service lists and communications records.

Core Elements to Include in a Professional Notice

A complete Notice of Representation contains identity, matter details, precise contact points, scope limits, effective dates, and signatory authority to prevent ambiguity and support admissibility.

Client Identity

Full legal name of the client, business entity type if applicable, and a client reference or account number to match the notice to a specific matter.

Attorney Identity

Name of the attorney or firm, bar number, firm address, phone, and email so recipients can verify counsel credentials and update service lists.

Matter Details

Case caption, docket or matter number, file number, or a short description of the subject matter to precisely tie the notice to the correct proceeding.

Scope of Authority

Clear statement of what the attorney is authorized to do (e.g., accept service, negotiate settlement, receive privileged documents) and any limitations.

Effective Dates

Date representation begins and, if applicable, date or conditions under which representation ends or will be withdrawn.

Signature and Contact

Signature block for the attorney or authorized firm representative with typed name, title, date, and where signed notices should be sent.

Step-by-Step: Preparing and Delivering the Notice

Follow these steps to create a clear, enforceable Notice of Representation and ensure recipients update their records correctly.

  • 01
Gather matter details: Collect client name, docket number, and case caption.
  • 02
Draft the notice: Include attorney identity, scope, effective date, and signature block.
  • 03
Select delivery method: Choose certified mail, electronic service, or hand delivery per local rules.
  • 04
Record delivery: Keep proof of service, delivery receipts, or eService confirmation for the file.

Where to File or Send the Notice and Typical Routing

The notice may be served on opposing counsel, filed with the court, or submitted to an administrative agency depending on the procedural context.

  • Opposing Counsel: Serve by agreed electronic service, email where permitted, or certified mail per local rules.
  • Court Clerk: File the notice with the court if local rules require filing of attorney appearance changes.
  • Agencies or Tribunals: Submit to the agency docket or case manager when representation concerns administrative matters.
  • Internal File: Store the executed notice and proof of delivery in the client matter file for recordkeeping.

  • Audit Trail: Capture timestamps, IP, and signer identity.
  • Privacy: Ensure HIPAA or confidentiality needs are addressed.

Timing and Key Deadlines to Consider

Timelines vary by court, agency, and contract; use this checklist to identify common time-sensitive events related to notices.

Upon Retention:

Issue the notice promptly when counsel is formally retained to avoid missed communications.

Before Filing:

File or serve the notice before or at the same time as filings that require counsel identification.

Response Windows:

Ensure service occurs before statutory or court response periods begin to preserve deadlines.

Change of Counsel:

Send updated notice immediately when representation changes to avoid service gaps.

Record Retention:

Keep proof of service and the signed notice for the document retention period applicable to the matter.

Authentication, Notarization, and Witness Steps (If Required)

Some jurisdictions or specific documents may require notarization, witness signatures, or remote online notarization; follow local rules when those requirements apply.

01

Confirm Local Rules

Check court or agency rules to determine if notarization or witness signatures are required.

02

Arrange Notary

Schedule an in-person or RON notary session if a notarized acknowledgement is needed.

03

Witness Presence

Ensure required number of witnesses sign in the notary's presence when applicable.

04

RON Identity Proofing

For RON, complete identity verification steps such as KBA or credential analysis.

05

A/V Recording Retention

If using RON, retain audio-video recordings as required by state law.

Notary Journal Entry

Have the notary record transaction details in the notary journal.

07

Attach Acknowledgement

Include the notarization certificate or acknowledgement with the notice copy.

08
