7. FAILURE TO COMPLY; ENFORCEMENT RIGHTS

If Recipient fails to complete the Required Remedial Actions by the Compliance Deadline, Notifying Party may, in addition to any other remedies available at law or in equity: (a) perform or cause performance of the remedial actions and charge Recipient for all associated costs; (b) suspend or terminate agreements or access; (c) seek injunctive or other equitable relief; and (d) recover attorneys' fees, costs and damages resulting from the failure to comply. Nothing in this Notice constitutes a waiver of rights or damages incurred prior to the date of this Notice.

8. MITIGATION; DUTY TO MINIMIZE

Recipient shall take all reasonable steps to mitigate any loss, damage or risk arising from the non‑compliance and shall cooperate with Notifying Party in any reasonable efforts to reduce damages or eliminate hazards.

All notices required or permitted under this Notice shall be in writing and shall be delivered by personal service, certified mail (return receipt requested), overnight courier, or email where receipt can be verified. Notices shall be addressed to the parties at the addresses set forth below or to such other address as a party may designate by written notice in accordance with this section.
