Recitals

WHEREAS, Defendant is charged in this matter with the offense(s) described as: ; and

WHEREAS, the parties have engaged in negotiation and the Prosecuting Authority has proposed terms under which the Defendant would enter a plea in resolution of the case, subject to court approval; and

10. Amendments; Waiver; Counterparts

10.1 Amendments. This Packet may be amended only by a written instrument signed by Defendant and an authorized representative of the Prosecuting Authority and approved by the Court where required.

10.2 Waiver. No waiver by any party of any breach or default under this Packet shall be a waiver of any subsequent breach or default.

10.3 Counterparts. This Packet may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument.

11. Governing Law; Entire Agreement; Severability

11.1 Governing Law. This Packet shall be governed by and construed in accordance with the laws of the jurisdiction in which the charged offense arose.

11.2 Entire Agreement. This Packet constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior written or oral agreements.

11.3 Severability. If any provision of this Packet is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
