What a Legal Publication Praecipe Is and When It’s Used

A Legal Publication Praecipe is a short court filing or clerk instruction asking the court clerk to publish a notice in a designated newspaper or official publication. It typically accompanies a summons by publication, probate notice, foreclosure notice, or other matters where personal service is impracticable. The praecipe identifies the case, specifies the publication schedule and dates, names the publication venue, and requests the clerk to issue the publication process and file proof of publication when completed.

Why a Praecipe Matters for Court Notice and Record

A praecipe starts the publication process required when personal service cannot be completed and ensures statutory notice obligations are met under state procedure and court rules. Electronic transmission and retained records support compliance with ESIGN and UETA where applicable.

Why a Praecipe Matters for Court Notice and Record

Typical Users and When They File a Praecipe

The praecipe is used by parties, counsel, and filing agents when publication is required by statute or court order. Common users are listed below.

  • Plaintiff or Plaintiff’s Counsel filing notice by publication for unknown defendants or service by publication.
  • Probate Administrators submitting notices to satisfy estate publication requirements.
  • Lenders or Special Servicers requesting foreclosure or tax lien publication when owner contact is unknown.

Use the praecipe to document the requested schedule and publication venue so the clerk and publication vendor can confirm completion and provide proof for the court record.

Step-by-Step: Filing a Praecipe for Legal Publication

Follow these procedural steps in order to submit a valid praecipe and obtain proof of publication for the court file.

  • 01
Confirm Court Order: Verify the judge’s order authorizing publication and its required frequency and duration.
  • 02
Select Publication: Choose a publication that meets statutory and local rules for circulation and format.
  • 03
Complete Praecipe: Fill the praecipe fields exactly, referencing the case caption, dates, and number of issues.
  • 04
File with Clerk: Submit the praecipe to the clerk per court filing rules and retain proof of submission.

Core Components to Include in a Professional Praecipe

A complete praecipe contains legal identifiers, precise publication instructions, and contact information so the clerk and publication vendor can act without additional requests.

Case Caption

Court name, county, and caption as on the complaint or petition to ensure proper docketing and linkage to the case file.

Case Number

Exact docket or case number assigned by the clerk; required for clerks to insert publication entries into the correct file.

Publication Venue

Official newspaper name, city, and vendor identification; some courts list approved publications by county.

Run Dates/Issues

Start date, end date, and the required number of consecutive issues or frequency per the court order.

Requester Contact

Name, address, phone, and email for the party or attorney requesting publication for follow-up and proof delivery.

Clerk Instructions

Any clerk-specific directions (e.g., submit affidavit of publication, return by mail, or upload to e-filing portal).

Information Always Required on the Praecipe

Court: Court name and county
Case Number: Docket number exactly
Caption: Party names as filed
Publication: Newspaper name and city
Dates: Start and end dates
Contact: Requesting party details

Configuring an Online Praecipe Workflow

Set up the digital workflow fields and routing to match court requirements and publication vendor inputs.

Field Configuration
Court Caption Required; locked after filing
Case Number Mandatory; exact match validation
Publication Vendor Select from approved list
Proof Delivery Upload affidavit or set auto-delivery to clerk

Digital Submission and eSignature Considerations

Courts and vendors accept electronic praecipes differently; ensure your platform supports required authentication, attachments, and delivery.

  • Document Formats: PDF or PDF/A preferred for court filings
  • Authentication: Email or two-factor signer verification
  • Audit Trail: Timestamp, IP address, and signer identity

Use e-filing and eSignature solutions that produce an auditable certificate of completion and retain the signed file in its original format for court proof.

Where to File or Send the Praecipe

The filing destination depends on local court rules and whether the jurisdiction allows electronic clerk submission or requires in-person delivery.

  • Court Clerk: File with the clerk following local e-filing or physical delivery rules
  • Publication Vendor: Send instructions directly if court permits vendor coordination
  • Mail or Email: Use clerk-prescribed method for submitting praecipes
  • E-Filing Portal: Attach praecipe and order if the court’s portal accepts it

Common Timelines and Deadlines for Publication Notices

Publication schedules and filing deadlines are set by statute or court order; confirm exact dates before submitting the praecipe.

Start Date:

Begin on the date specified by the court order

Consecutive Issues:

Run for the ordered number of consecutive publications

Affidavit Filing:

File proof of publication by the court's deadline

Service Period:

Allow statutory period after final publication before default or judgment

Clerk Processing:

Processing times vary by court — confirm local expectations
