What the Legal Real Estate Disclosure Form Is

The Legal Real Estate Disclosure Form is a written statement completed by a property seller (or landlord) that describes known material facts about a property’s condition, hazards, or legal status. It typically covers structural issues, water intrusion, pest infestations, past repairs, environmental hazards, and any legal encumbrances that could affect value or habitability. The form exists to inform prospective buyers or tenants so they can make an informed decision, negotiate remedies, or request inspections before the transaction closes.

Why accurate disclosures matter

Clear, complete disclosures reduce legal risk, support market transparency, and protect both parties from post-closing disputes by documenting what the seller knew and communicated.

Why accurate disclosures matter

Who typically prepares and relies on this form

Attorneys and closing agents also review the completed disclosure to confirm consistency with contract terms and title documents.

  • Listing agents and brokers who collect seller-provided property facts for buyers and files.
  • Sellers (property owners) who must truthfully report known defects and past remediation.
  • Buyers, lenders, and title companies who assess risk, underwriting, and insurability.

Core elements included in a professional disclosure

A properly drafted disclosure groups facts so readers can rapidly locate condition statements, legal items, and supporting evidence.

Property Details

Street address, parcel or legal description, and occupancy status; essential for matching the disclosure to the recorded property and title work.

Seller Disclosures

Seller statements about known defects, prior claims, insurance losses, or renovations; should be specific and dated to reduce ambiguity in later disputes.

Known Defects

Explicit descriptions of structural, electrical, plumbing, and HVAC issues including dates, repairs performed, and contractors used where available.

Environmental Issues

Items such as lead-based paint, asbestos, radon, or underground storage tanks; include testing results or disclosures required by federal or state law.

Attachments

Supporting documents like inspection reports, receipts for repairs, permits, photographs, and notices are attached and referenced in the form.

Seller Certification

A signed and dated certification by the seller attesting to the form’s completeness and accuracy, and identifying any limitations to their knowledge.

Common mistakes to avoid when preparing the disclosure

  • Leaving fields blank or writing 'unknown' without reasonable inquiry, which can create ambiguity and post-closing disputes.
  • Failing to attach inspection reports or permits referenced in the disclosure and thus undermining the seller's statements.
  • Using vague language like 'minor issues' without specifics on location, date, or remediation performed.
  • Submitting inconsistent disclosures across platforms or versions, which can invalidate statements or delay closing.

Potential legal and financial consequences of incorrect disclosures

Civil Liability: Damages or rescission risk
Contract Rescission: Buyer may cancel purchase
Title Problems: Insurance may refuse coverage
Regulatory Fines: State penalties possible
Closing Delays: Undisclosed defects can postpone closing
Increased Costs: Remediation or settlement expenses
