What the Legal Referral Packet Is

A Legal Referral Packet is a standardized collection of documents and client data created to transfer a matter from one attorney or firm to another, or to refer a client to a specialist. It typically bundles contact information, case summaries, key dates, relevant evidence or exhibits, client authorizations, and a cover letter that explains the reason for referral and any pending deadlines. The packet clarifies scope, identifies conflicts, and helps the receiving lawyer assess costs, jurisdictional issues, and immediate next steps without repeated information requests.

Why a Complete Packet Matters

A complete Legal Referral Packet reduces intake delays, limits miscommunication, and preserves client confidentiality during transfer. It documents the referral basis, highlights urgent deadlines, and provides the receiving counsel with the facts needed to accept or decline representation promptly.

Why a Complete Packet Matters

Who Prepares and Receives These Packets

Clear packet authorship and client consent speed onboarding and reduce the need for follow-up requests.

  • Referring attorney or firm preparing background materials and conflict information for the receiving lawyer.
  • Receiving counsel or specialist evaluating case merits, jurisdictional fit, and potential engagement terms.
  • Client or authorized representative providing consent and verification for information transfer and continued representation.

Step-by-Step: How to Assemble the Packet

Complete these steps in order to create a usable packet that minimizes follow-up and speeds client onboarding.

  • 01
Gather Records: Collect pleadings, correspondence, billing summaries, and relevant exhibits.
  • 02
Write Summary: Draft a factual timeline and current status in plain language.
  • 03
Obtain Consent: Get the client’s written authorization to share files and to transfer representation.
  • 04
Package and Send: Use secure delivery and include a cover memo describing required next steps.

Typical Referral Workflow

A standardized referral workflow reduces friction and helps the receiving attorney make a timely acceptance decision.

  • Referral Request: Referrer identifies need and compiles packet for transmission.
  • Preliminary Review: Receiving counsel reviews summary and exhibits for conflicts and scope.
  • Client Contact: Receiving counsel contacts client to confirm interest and consent if needed.
  • Formal Engagement: Engagement letter or declination sent with instructions for file transfer.

Include these components to ensure the receiving lawyer has a clear, organized record of the matter and immediate action items.

List court filing dates and statute-of-limitations dates as MM/DD/YYYY.

Response Dates:

Include deadlines for responses, discovery, and scheduled hearings.

Payment Dates:

Note upcoming retainers, fee deadlines, or arbitration payment windows.

Recommend a 7–14 day review period for initial acceptance decisions.

Common Preparation Mistakes to Avoid

  • Incomplete client consent forms that lack explicit authorization for record transfer and communication with the receiving attorney.
  • Unclear matter summaries that omit key dates or procedural posture, forcing the receiving counsel to request clarifying information.
  • Missing or unindexed exhibits, which slow document review and create risk that important evidence is overlooked.
  • Failing to perform a conflicts check or to provide sufficient identifying information for the receiving firm to complete one promptly.

Risks and Consequences of an Improper Packet

Conflicts Risk: Disqualification or ethical violations
Statute Risk: Missed filing deadlines or statute-barred claims
Privacy Risk: HIPAA or privacy breaches and regulatory fines
Fee Risk: Unpaid balances and fee disputes
Evidence Loss: Missing exhibits or chain-of-custody issues
Reputational: Client dissatisfaction and referral breakdowns

Practical Tips for Accurate Packet Preparation

Adopt these practices to minimize errors, protect client data, and simplify the receiving lawyer’s assessment.

Use Clear Summaries
Write a one-page factual summary with key dates and relief sought. Clear summaries reduce review time and misinterpretation.
Verify Client Consent
Secure a signed client authorization that explicitly permits disclosure of records and confirms the client understands the referral process.
Index Attachments
Provide an exhibit index with Bates ranges or file names, and use searchable PDF formats to speed electronic review.
Secure Transfer
Use encrypted delivery and authenticated access to limit exposure and to create an audit trail of document access.
