What a Legal Representation Request Is and when it applies

A Legal Representation Request is a written authorization used to designate an attorney or law firm to represent an individual or organization in a specific legal matter. The document identifies the parties, scope of representation, effective dates, and any limitations or special instructions, and it may specify fee arrangements and confidentiality terms. Legal Representation Requests are used in litigation, transactional work, administrative proceedings, and insurance claims. When properly completed and executed, the request creates an attorney-client relationship and clarifies responsibilities between the client and counsel.

Why a clear request matters for intake and risk control

Use a Legal Representation Request to document authority, set the representation scope, and record fee and communication expectations. A clear request reduces misunderstandings, speeds intake, and establishes the record needed for billing, conflicts checks, and professional responsibility compliance.

Why a clear request matters for intake and risk control

Who typically completes a Legal Representation Request

Typical users include individuals, corporations, insurers, and government agencies that need to formalize attorney representation before legal or administrative actions.

  • Private clients who need counsel for litigation, transactions, or negotiations and require formal scope and fee terms.
  • In-house counsel or companies documenting outside counsel authority for procurement, claims management, or regulatory matters.
  • Insurers assigning defense counsel or government agencies appointing counsel for administrative hearings and appeals.

Accurate completion at intake minimizes delays, supports compliance checks, and provides a defensible record for billing and dispute resolution.

Primary signer roles

Client

Attorney

The lawyer or law firm accepting representation; list firm name, primary attorney, bar jurisdiction, and contact information. State any conditions of acceptance, limitations on scope, fee structure, and whether the firm will appear pro hac vice or as local counsel.

Required identification and core data fields

Scope of Representation: Describe matters and limits in plain terms

Common preparation pitfalls to avoid

  • Using informal language or vague scope that leaves open whether specific claims or proceedings are included, causing disputes over counsel authority.
  • Failing to list precise client contact and billing information, which delays invoicing, conflict checks, and notice delivery during time-sensitive matters.
  • Not specifying fee arrangement or retainers, leaving ambiguity about who pays, when fees are due, and whether costs are reimbursable.
  • Skipping signature authentication methods or notarization where required, increasing risk that courts or third parties will reject the document.

Consequences of incorrect or incomplete requests

Invalid Authorization: May void representation
Conflict of Interest: Disciplinary risk to counsel
Missed Deadlines: Procedural default possible
Billing Disputes: Unclear fee terms cause disputes
Notarization Omitted: Some filings require notarized signature
Incorrect Signer: Failure to bind entity
