WHEREAS, Responding Party () is the party served with this Request for Admissions and may admit or deny the matters set forth below pursuant to the applicable rules of civil procedure;

WHEREAS, the parties intend that Requests for Admission reduce issues for trial by establishing facts and documents not in dispute;

NOW THEREFORE, pursuant to the applicable rules of civil procedure, Requesting Party hereby propounds the following Requests for Admission on Responding Party. Responding Party must answer or object to each request separately and fully in writing as provided below.

1. DEFINITIONS

For purposes of these Requests, the following definitions apply: (a) "Document" means any writing, recording, photograph, or electronically stored information, including all non-identical copies and drafts; (b) "Communication" means any oral or written transfer of information; (c) "Person" means any natural person, corporation, partnership, association, or other legal entity; and (d) "You" or "Your" refers to Responding Party and any agent, attorney, or representative acting on its behalf.

2. INSTRUCTIONS

2.1 Each request shall be answered separately and fully, based on all information known or readily obtainable by Responding Party. If you object to any request, state the specific legal and factual basis for the objection and answer the remainder of the request that is not objectionable. If you admit only a portion of a request, set forth the specific portion admitted and deny or qualify the remainder with specificity.

2.2 A denial must fairly meet the substance of the requested admission and, where appropriate, state any circumstances under which the denial would be withdrawn. If you cannot truthfully admit or deny because you lack sufficient information after reasonable inquiry, so state, set forth the efforts made to obtain the information, and provide whatever information you do have.

2.3 These Requests call for the admission of the genuineness of documents. For any document to which genuineness is requested, identify the document by title or Bates number, describe its nature, and provide the custodian if known.

3. REQUESTS FOR ADMISSION

Responding Party is requested to admit the truth of the following statements or the genuineness of the documents described. Each statement or document shall be treated as a separate Request for Admission. Responding Party shall state for each numbered request whether it admits, denies, or states that it lacks sufficient information to admit or deny, and shall provide a brief explanation for any denial or qualification.

Time to respond (in days):

4. RESPONSE FORMAT

For each numbered Request, Responding Party shall provide either: (a) an admission that the matter is true; (b) a specific denial of the matter; or (c) a statement that Responding Party lacks sufficient information to admit or deny after reasonable inquiry. Where an objection is asserted, Responding Party must state the specific grounds and nevertheless answer any portion of the request that is not objectionable. Where partial admission is made, the response must clearly state the portion admitted and the portion denied.

5. DOCUMENT IDENTIFICATION

If a request seeks admission as to the genuineness of a document, Responding Party must admit or deny the genuineness of the particular document and, if denying, identify the basis for the denial and identify any person having custody of an authentic copy.

6. NON-WAIVER AND PRESERVATION

These Requests are propounded without waiver of any objections to admissibility at trial. Responding Party is directed to preserve all documents and electronically stored information that may be responsive to any request or relevant to the subject matter of the action.

What a Legal Request for Admissions Is

A Legal Request for Admissions is a written discovery demand used in U.S. civil litigation to ask an opposing party to admit the truth of facts, the application of law to facts, or the genuineness of documents. Governed by federal and state discovery rules, commonly Federal Rule of Civil Procedure 36 in federal cases, it narrows contested issues by obtaining binding admissions if not timely denied. Responses must follow procedural requirements and may include admissions, qualified answers, or objections. Proper drafting and service reduce trial time, limit proof burdens, and clarify the disputed factual record.

Why Requests for Admissions Matter in Litigation

Using a Legal Request for Admissions focuses litigation by securing conceded facts or authenticating documents, often eliminating the need to prove uncontested elements at trial. It can reduce discovery costs, shorten hearings, and strengthen settlement positions when strategically deployed under Rule 36.

Why Requests for Admissions Matter in Litigation

Who Typically Prepares and Responds

Typical users include litigants, defense and plaintiff attorneys, and in-house counsel handling civil disputes.

  • Plaintiff attorneys seeking admitted facts to streamline proof and narrow trial issues.
  • Defense counsel testing allegations and forcing opponents to authenticate documents early in litigation.
  • Self-represented litigants may use a request when court rules permit formal discovery without counsel.

Courts treat admissions differently by jurisdiction; follow local rules and timing to avoid waiver or default admissions.

Essential Parts of a Professional Request for Admissions

Core sections in a Legal Request for Admissions include caption, numbered requests, definitions, instructions, signature block, and certificate of service.

Caption

Case caption identifies court, parties, docket number, and procedural posture; accurate captioning ensures proper service and helps the responding party locate the discovery in the case file.

Definitions

Definitions section clarifies terms, date ranges, and referenced documents; precise definitions prevent disputes over scope and reduce objections during discovery and trial.

Requests

Numbered requests state single facts or document genuineness per item; each should be concise, fact-specific, and avoid compound phrasing that encourages partial answers or objections.

Instructions

Instructions explain required response format, deadline to admit or deny, and how to respond to document requests or mixed law-and-fact questions.

Signature

Signature block lists counsel or party name, mailing address, telephone, email, and date; signing attorney certifies good-faith basis for objections and the truthfulness of factual admissions.

Certificate

Certificate of service states how and when the request was served, including method and date — essential for proving timely delivery under local rules.

Timelines and Response Deadlines to Watch

Key deadlines for a Legal Request for Admissions depend on service date and governing discovery rules; observe federal Rule 36 and applicable local variations.

Federal Rule 36 response deadline:

30 days after service unless court orders otherwise

State and local rule variations:

Deadlines vary; some courts shorten or extend time

Agreements to extend response deadlines:

Parties may stipulate extensions; file stipulations per local rules

Consequence of failing to timely respond:

Untimely responses may result in deemed admissions

Challenging objections or seeking relief:

File motions to compel or withdraw admissions per rules

Common Drafting and Service Pitfalls

  • Using compound or multi-part requests that force answers to multiple unrelated facts leads to objections and partial admissions that undermine clarity and increase motion practice.
  • Failing to define key terms and date ranges results in vagueness objections and can permit broad or evasive responses from opposing parties.
  • Serving requests without properly completing the certificate of service or using incorrect service methods can invalidate service and restart response deadlines.
  • Overusing admissions for disputed legal conclusions rather than factual matters increases objections and often triggers extensive motion briefing.

Consequences of Procedural Errors

Deemed Admissions: Untimely responses can create automatic admissions
Motion Sanctions: Court may impose fees and sanctions
Lost Defenses: Admission may eliminate affirmative defenses
Evidence Preclusion: Admitted facts are binding at trial
Cost Exposure: Attorney fees and discovery costs may increase
Reopening Requests: Courts rarely allow withdrawal without good cause

How Requests for Admissions Work in Real Cases

Practical examples show how narrowly framed admissions reduce trial proof and speed case resolution.

Property Dispute

A plaintiff seeking title confirmation served twenty admissions to lock in ownership facts and narrow trial issues before hearing.

  • Resulted in several uncontested facts and a narrowed liability focus.
  • By obtaining admissions on the authenticity of recorded deeds and boundary facts, counsel reduced evidentiary disputes, shortened cross-examination needs, and positioned the case for a favorable settlement without multiple expert depositions.

Employment Dispute

An employer used focused admissions to resolve disputed dates and policies in an employment discrimination case pre-trial.

  • Admissions clarified timelines and limited contested issues at hearing.
  • Narrowly framed requests compelled admissions about specific performance reviews and policy notices, reducing the number of live witnesses and concentrating litigation on damages rather than basic facts, which expedited settlement discussions.

How Requests for Admissions Differ from Other Discovery Tools

Compare Requests for Admissions to interrogatories to understand purpose, scope, and evidentiary effect in litigation.

Criteria Requests for Admissions Interrogatories
Purpose narrow facts gather factual narrative
Typical Length short, specific items longer, descriptive answers
Evidentiary Effect binding if admitted not binding
Common Use authenticate docs, narrow issues develop facts, identify witnesses
