What the Legal Request for IED Is and When It’s Used

A Legal Request for IED is a formal written submission that asks parties to begin an Independent Expert Determination (IED) process under contract or by agreement. It frames the dispute or question, identifies the proposed independent expert, and sets the scope, timing, and initial evidence or documents for review. The request is commonly used in commercial contracts, construction disputes, technical disputes, and professional standards matters where parties prefer an expert decision on a narrow factual or technical issue rather than full arbitration or litigation.

Why Use a Legal Request for IED

The request streamlines technical or specialist disputes by naming an impartial expert, defining the scope, and creating a record of the issue and the parties’ positions. It reduces discovery and hearing costs, narrows factual questions for decision, and preserves options for later arbitration or litigation if the parties agree to that path.

Why Use a Legal Request for IED

Who Typically Prepares or Signs This Request

Parties, counsel, or contract administrators prepare the request to initiate expert determination; its author should be authorized under the governing contract.

  • Contracting parties and in-house counsel preparing the formal initiation document with scope and timelines.
  • Project managers or engineers for technical disputes who supply supporting documents and expert proposals.
  • Outside litigators or dispute-resolution counsel who draft procedural protections and preserve evidentiary positions.

Signatories include the requesting party and the responding party; counsel signatures and dated attestations improve clarity on authority and acceptance.

Common Mistakes to Avoid When Preparing the Request

  • Failing to confirm the sender's contractual authority before nominating an expert, which can lead to disputes over the expert's jurisdiction and the request's validity.
  • Submitting incomplete or unnumbered exhibits that impede the expert's review and create unnecessary requests for supplemental materials and delays.
  • Neglecting to include a conflict disclosure for the proposed expert, which can result in an objection and the need to restart nomination.
  • Omitting clear timelines or fee allocation terms, which often triggers procedural fights over scheduling and cost responsibility.

Penalties and Risks of an Incorrect or Improper Request

Waiver Risk: Loss of procedural rights
Cost Shifting: Adverse allocation of expert fees
Delay: Extended dispute resolution timeline
Evidence Exclusion: Expert may refuse late materials
Enforceability Issues: Challenge to binding effect
