RECITALS

WHEREAS, Applicant has submitted a sworn affidavit setting forth facts that establish probable cause to believe that the subject resides at or maintains the premises described above and that verification, inspection, or limited entry is necessary to determine legal residence for purposes of administration, enforcement, or judicial proceedings; and

WHEREAS, the issuing authority is empowered under applicable law to authorize entry onto residential premises for the limited purpose of verifying legal residence, subject to constitutional protections against unreasonable searches and seizures, and to impose conditions designed to protect occupant privacy and safety; and

WHEREAS, the facts set forth in the affidavit, together with such other information as the issuing authority has considered, provide a factual basis sufficient to issue this Legal Residence Warrant under the standards of probable cause and narrowly tailored scope.

NOW, THEREFORE, in consideration of the foregoing recitals and the authority vested in the undersigned, it is ORDERED as follows.

1. AUTHORITY

This warrant is issued pursuant to the statutory and constitutional powers vested in the issuing authority. It authorizes the Applicant and any designated agents identified herein to enter the premises described above for the limited purposes and subject to the conditions contained in this instrument.

2. DEFINITIONS

For purposes of this warrant: (a) "Premises" means the specific residential unit or dwelling at the address identified above; (b) "Entry" means non-forcible or forcible physical entry as authorized in Section 4; and (c) "Verification" means observation, interview, inspection of residency records found on the premises, and limited photographic documentation necessary to establish residency.

3. GRANT OF WARRANT

The issuing authority hereby authorizes Applicant, accompanied where appropriate by a peace officer, to enter the Premises during daylight hours, unless exigent circumstances are specifically found and endorsed in writing below, for the limited purpose of verifying the legal residence of the named subject and collecting evidence directly relevant to that verification. The scope of any search is limited to locations within the Premises reasonably likely to contain residency documentation.

4. SCOPE AND LIMITATIONS

a) Entry shall be no more invasive than reasonably necessary to accomplish verification. b) No routine or generalized inventory or seizure of personal property is authorized except for documents and items reasonably necessary to establish or refute residence at the Premises. c) Occupant consent, if freely given, may expand permitted actions but shall not be considered required by this warrant.

5. EXECUTION PROCEDURES

Applicant shall: (a) present and explain the warrant to any occupant at the earliest practicable time upon entry; (b) limit documentation and photographic capture to those items necessary to verify residence and record the identity of any person encountered; (c) prepare a written inventory of any documents or items removed from the Premises, with copies provided to the occupant where practicable; and (d) avoid any destruction or unnecessary disturbance of personal property.

6. PROTECTION OF RIGHTS

Nothing in this warrant shall be construed to waive any constitutional or statutory rights of occupants. If criminal activity unrelated to residence verification is observed during execution, Applicant shall cease the verification activity only to the extent required to address immediate safety concerns and shall document the circumstances in the return.

7. RETURN AND REPORTING

Applicant shall file a written return within the timeframe required by law, certifying the date and manner of execution, persons present at the Premises, items inspected or seized, and the factual basis for any conclusions as to residence. The return shall include a copy of the inventory described in Section 5(c).

8. PENALTIES

Any intentional violation of the limitations of this warrant by Applicant or agents may subject the violator to administrative discipline, civil liability, and criminal penalties as provided by law. Evidence obtained in violation of constitutional or statutory protections may be excluded from subsequent proceedings.

13. AMENDMENTS; WAIVER; COUNTERPARTS

Any amendment or waiver of this warrant must be made in writing and signed by the issuing authority. A failure to insist upon strict compliance with any provision shall not constitute a waiver of that or any other provision. This warrant may be executed in counterparts.
