What a Legal Retainer Form Is and When It Applies

A Legal Retainer Form is a written agreement that records the engagement between a client and an attorney or law firm, including the scope of representation, fee structure, retainer deposit, billing and trust-account treatment, termination rights, conflict disclosures, and governing law. It creates an enforceable contract setting expectations for services and payment, and often includes client authorization for credit-card charges, hourly or flat-fee arrangements, and limited scope representations. Properly executed, a retainer clarifies responsibilities and reduces later disputes about fees or the scope of work.

Why a Clear Retainer Form Matters for Clients and Firms

A precise retainer reduces billing disputes, documents consent to representation terms, and preserves fee recovery options.

Why a Clear Retainer Form Matters for Clients and Firms

Who Typically Completes a Legal Retainer Form

Legal retainers are completed during client intake, matter opening, or when the scope or fee arrangement changes.

  • Solo attorneys and small firms onboarding a new individual client for discrete matters.
  • Law firm intake teams setting terms for corporate or ongoing engagements.
  • In-house legal departments documenting outside counsel arrangements and fee authorizations.

Retainers should be signed before substantive work begins or when a deposit is required to open a trust account.
