What the Legal RFE Follow Up Form Is

The Legal RFE Follow Up Form is a structured cover sheet and evidence index used to respond to a United States Citizenship and Immigration Services (USCIS) Request for Evidence (RFE). It collects case identifiers (receipt number, A-number), party contact details, a short narrative addressing each requested item, and an organized exhibit list. The form helps map each RFE request to specific documents, creates a dated cover letter for submission, and preserves an auditable record of what was provided to USCIS during the specified response period.

Why a Structured RFE Response Matters

Use the Legal RFE Follow Up Form to present a focused, traceable response that directly addresses USCIS requests, reduces the chance of denial due to missing evidence, and documents the chain of custody for submitted materials while meeting procedural timing requirements.

Why a Structured RFE Response Matters

Who Typically Completes This Form

Common users who complete or review the Legal RFE Follow Up Form include immigration attorneys, petitioners, and accredited representatives.

  • Immigration attorneys and law firms preparing organized, item-by-item responses and evidence indexes for USCIS.
  • Petitioners and applicants assembling personal records, affidavits, and certified documents for submission.
  • Paralegals and case managers tracking deadlines, tabbing exhibits, and maintaining audit trails for client files.

Ensure the signer and preparer sections are completed and retained with the case file for future reference.

Core Components to Include

A professional Legal RFE Follow Up Form groups identification, direct responses, and organized evidence so USCIS adjudicators can verify each requested item quickly.

Cover Letter

A dated cover letter referencing the USCIS receipt number and RFE date, summarizing the response and listing attached exhibits; signed by the petitioner or attorney and placed on top of the packet.

Case Identifiers

Clear display of receipt number, alien registration number (A-number), petition type, and USCIS office to ensure proper matching and prevent misfiling during intake and review.

Response Summary

A concise, itemized narrative that addresses each RFE point in the same order used by USCIS, noting where each piece of evidence appears in the exhibit index.

Evidence Index

A numbered list of exhibits with descriptive labels, Bates ranges or page numbers, and brief notes linking each exhibit to the corresponding RFE request item.

Exhibit Tabs

Physical or PDF bookmarks that separate exhibits, with front-page labels matching the index; include translations and certifications where required.

Submission Log

A dated log recording delivery method, tracking numbers, and the person who prepared and sent the response for audit and appeal purposes.

Step-by-Step: Completing the Form

Follow these steps to assemble, verify, and submit a complete RFE response to USCIS within the required timeframe.

  • Online Account: If the RFE permits, upload documents to the USCIS online case account.

Timelines and Typical Deadlines

RFE response deadlines are set on the USCIS notice; meet the exact date provided and confirm allowed submission methods.

Typical RFE Deadline:

Often 30–90 days as specified on the notice; check the exact date.

Receipt Number Use:

Include the receipt number on every page to avoid processing delays.

Mailing Lead Time:

Allow additional transit time for courier or postal delivery.

Online Upload Timing:

Uploads are effective on successful USCIS portal receipt.

Late Responses:

Late submissions risk denial or refusal of the requested benefit.

Common Mistakes to Avoid

  • Failing to reference the receipt number on all exhibits and the cover letter, which can lead to misfiling and processing delays.
  • Submitting untranslated foreign-language documents without certified English translations and translator declarations, causing evidence to be disregarded.
  • Providing evidence that does not specifically address the RFE item or relying on vague statements instead of documentary proof.
  • Omitting signatures, dates, or required attestations on affidavits and letters, which can render them non‑probative to adjudicators.

Consequences of an Incorrect or Incomplete Response

Denial: USCIS may deny the underlying petition.
Delay: Processing delayed while USCIS seeks clarifications.
Evidence Rejection: Uncertified translations or inadmissible documents may be ignored.
Appeal Complexity: A denial increases time and cost for motions or appeals.
Financial Risk: Lost filing fees for the original petition may occur.
Record Issues: Incomplete logs hinder administrative or appellate review.

Supporting Documents Commonly Attached

Include original or certified copies, translations, and any corroborating evidence tied directly to the RFE requests for strongest effect.

Passport and IDs

Copies of passport biographic pages and government IDs showing names and dates; include clear scans and redactions where appropriate for privacy.

Birth/Marriage Certificates

Certified copies or extracts with English translations; include chain-of-custody or apostille if the RFE requests authentication.

Employment Evidence

Employer letters on company letterhead, pay records, and tax forms that directly corroborate employment claims and dates asserted in the petition.

Medical or School Records

Official transcripts, letters, or medical reports with certified translations and translator declarations where foreign-language materials are provided.
