LEGAL RRP RULE STATEMENT

RECITALS

NOW, THEREFORE

In consideration of the mutual covenants set forth below, the parties agree as follows:

1. DEFINITIONS

1.1 "RRP Rule" means the federal Renovation, Repair and Painting rule governing lead-based paint activities as applied to target housing and child-occupied facilities. "Renovation" means altering a painted surface or component that may disturb paint. "Covered Work" means the specific renovations described in Section 2.

2. SCOPE OF WORK

Contractor shall perform the following work at the property located at :

3. CONTRACTOR CERTIFICATIONS AND TRAINING

3.1 Contractor certifies that all renovators and on-site supervisors performing Covered Work have successfully completed an accredited RRP training course and are assigned in writing to the job. Training date (most recent): .

3.2 Contractor shall maintain copies of certifications, training records, and documentation of on-site supervisory assignments and shall make such records available to Client upon request.

4. REQUIRED WORK PRACTICES

4.1 Contractor shall employ containment, use wet methods or HEPA-equipped tools where appropriate, and minimize dust generation. Contractor shall ensure that all waste generated by Covered Work is collected, transported and disposed of in a manner consistent with applicable laws and the RRP Rule's waste handling requirements.

4.2 Contractor shall perform post-renovation cleaning and, where required by the RRP Rule, clearance testing. Clearance testing requested: .

5. CLIENT OBLIGATIONS

5.1 Client shall provide Contractor with access to the property and a list of occupants and sensitive receptors (e.g., children under six, pregnant persons) if known. Client acknowledges and agrees to provide written occupant notification where the RRP Rule requires pre-renovation notices.

5.2 Client shall temporarily relocate occupants when recommended by Contractor or required by local regulation to ensure safe performance of Covered Work.

6. RECORDKEEPING AND RETENTION

Contractor shall retain records of all Covered Work, including training records, signed acknowledgements, pre-renovation notifications, cleaning checklists, and clearance test results for a period of three (3) years from the date of completion of the Covered Work, or for such longer period as required by applicable law.

7. REPRESENTATIONS AND WARRANTIES

Contractor represents and warrants that Covered Work will be performed in a professional manner in accordance with the RRP Rule and standard industry practices for lead-safe work. Contractor does not warrant the absence of preexisting lead hazards unrelated to the Covered Work.

8. INDEMNIFICATION

Contractor shall indemnify, defend and hold harmless Client from and against all losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of Contractor's negligent or willful failure to comply with the RRP Rule or this Statement, except to the extent caused by Client's negligence or willful misconduct.

9. INSURANCE

Contractor shall maintain commercially reasonable insurance, including general liability and pollution/abatement coverage where applicable, with limits sufficient to cover liabilities arising from Covered Work. Contractor shall provide certificates of insurance to Client upon request.

10. REMEDIES; LIMITATION OF LIABILITY

Except for liabilities arising from gross negligence or willful misconduct, neither party shall be liable to the other for consequential, incidental or punitive damages. The parties' aggregate liability under this Statement shall be limited to amounts recoverable under Contractor's applicable insurance coverages.

11. NOTICES

All notices required or permitted under this Statement shall be in writing and delivered to the addresses below by hand, certified mail, or overnight courier. Notices shall be effective upon delivery.

12. MISCELLANEOUS

12.1 Governing Law. This Statement shall be governed by and construed in accordance with the laws of the state where the property subject to Covered Work is located without regard to conflict of laws principles.

12.2 Entire Agreement. This Statement constitutes the entire agreement between the parties with respect to Contractor's obligations under the RRP Rule and supersedes all prior agreements and understandings, whether written or oral, relating to the same subject matter.

12.3 Severability. If any provision of this Statement is held to be invalid or unenforceable by a court of competent jurisdiction, the remainder of this Statement shall remain in full force and effect to the fullest extent permitted by law.

12.4 Amendments and Waiver. Any amendment or modification to this Statement must be in writing and signed by both parties. Failure to enforce any provision shall not be deemed a waiver of future enforcement of that or any other provision.

12.5 Counterparts. This Statement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument.
