Legal Season Waiver

LEGAL SEASON WAIVER

This Legal Season Waiver (the "Waiver") is entered into as of by and between Organization Name: (the "Organization") and Participant Name: (the "Participant").

RECITALS

WHEREAS, the Organization sponsors, organizes and conducts a season of activities described as (the "Season") consisting of training, practices, games, travel, and related events (the "Activities");

WHEREAS, the Participant desires to participate in the Activities and the Organization requires execution of this Waiver as a condition to participation; and

WHEREAS, the parties desire to set forth their respective rights and obligations with respect to risks, releases, medical treatment and indemnification arising from the Participant's participation in the Season.

NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the parties agree as follows:

1. DEFINITIONS

For purposes of this Waiver, the following terms shall have the meanings set forth below:

a) "Activities" means all practices, games, competitions, travel, training, tryouts, warm-ups, demonstrations, clinics and other events organized by the Organization during the Season described above.

b) "Releasees" means the Organization and its affiliates, directors, officers, employees, volunteers, coaches, agents, independent contractors, sponsors and insurers.

2. ASSUMPTION OF RISK

The Participant acknowledges and understands that participation in the Activities involves inherent risks including, without limitation, physical injury, permanent disability, paralysis and death. The Participant voluntarily and knowingly assumes all risks associated with participation in the Activities, whether known or unknown, foreseeable or unforeseeable, including but not limited to risks arising from the negligence of the Releasees.

Participant status: Minor Adult

If the Participant is under 18 years of age, Guardian Name: represents and warrants that the undersigned guardian has the legal authority to execute this Waiver on behalf of the minor Participant and hereby consents to the minor's participation.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, the Participant hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Releasees for any and all liability, claims, demands, actions or causes of action arising out of or related to any loss, damage or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, while participating in or traveling to or from the Activities, whether caused by the negligence of the Releasees or otherwise.

The Participant understands that this release includes any claims based on negligence, but does not waive claims for gross negligence or willful misconduct where such waiver would be unenforceable under governing law.

4. INDEMNIFICATION

The Participant agrees to indemnify, defend and hold harmless the Releasees from and against any and all claims, demands, liabilities, losses, damages, costs and expenses (including attorneys' fees and court costs) arising out of or related to the Participant's acts or omissions in connection with the Activities, including any third-party claims brought as a result of the Participant's conduct.

5. MEDICAL AUTHORIZATION

The Participant authorizes the Organization and its agents to secure emergency medical treatment for the Participant if needed and to transport the Participant to a medical facility. The Participant agrees to be responsible for all costs and expenses related to such treatment and transportation.

6. MEDIA RELEASE

The Participant hereby grants to the Organization the irrevocable right to use, reproduce, distribute, and display photographic and video images of the Participant taken in connection with the Activities for promotional, instructional, and archival purposes, in any medium.

7. TERM; TERMINATION

This Waiver is effective as of the date set forth above and shall remain in effect for the duration of the Season and for any period during which the Participant engages in Activities related to the Season. The Organization may terminate the Participant's participation for failure to comply with rules or for conduct that endangers others, without prejudice to the Organization's right to enforce the terms of this Waiver.

9. MISCELLANEOUS

Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of without regard to conflict of laws principles.

Entire Agreement: This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.

Severability: If any provision of this Waiver is held to be invalid, illegal or unenforceable in any respect, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

Amendments; Waiver: No amendment or waiver of any provision of this Waiver shall be effective unless in writing and signed by both parties. The failure of either party to enforce any provision of this Waiver shall not constitute a waiver of future enforcement of that or any other provision.

Counterparts: This Waiver may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument.

REPRESENTATIONS AND SIGNATURE

The undersigned represents and warrants that the undersigned has read this Waiver, fully understands its terms and implications, and signs it voluntarily. If signing on behalf of a minor Participant, the undersigned further represents that they are the legal guardian and have full authority to execute this Waiver on behalf of the minor.
