LEGAL SEPARATION WAIVER

This Legal Separation Waiver (the "Agreement") is entered into on by and between Party A: whose address is , and Party B: whose address is .

RECITALS

WHEREAS, the Parties were married on and have since separated; and

WHEREAS, the Parties reside in the State of and there is a pending or contemplated legal separation proceeding identified as Case No. ; and

WHEREAS, the Parties desire to settle and finally resolve certain rights and obligations arising from their marital relationship and separation, and to waive certain claims and remedies as set forth herein.

NOW, THEREFORE, in consideration of the mutual covenants and promises contained in this Agreement and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

For purposes of this Agreement: (a) "Claims" means any and all past, present or future actions, causes of action, suits, debts, obligations, liabilities, agreements, promises, demands, rights, damages, losses, costs and expenses (including attorneys' fees) arising out of the marital relationship or separation; (b) "Marital Property" means property acquired by either or both Parties during the marriage, regardless of title; and (c) "Separate Property" means property owned prior to marriage or acquired by gift or inheritance, as properly proven.

2. MUTUAL WAIVER AND RELEASE

Except as expressly provided in this Agreement, each Party, on behalf of himself or herself and his or her heirs, executors, administrators, representatives and assigns, hereby irrevocably and unconditionally waives, releases and forever discharges the other Party and the other Party's agents, heirs, assigns and representatives from any and all Claims of every nature and description, whether known or unknown, suspected or unsuspected, that arise out of or relate to the marital relationship, separation, or division of marital property existing through the Effective Date.

The foregoing mutual waiver and release specifically includes, without limitation, claims for spousal support, alimony, division of marital assets, claims to pensions, retirement benefits, stock options, business interests, and claims for reimbursement or credits except as expressly reserved in Section 2.1 below.

Each Party hereby covenants and agrees not to initiate, maintain, or otherwise assert any Claim released by this Agreement in any judicial, administrative or arbitration proceeding. Each Party shall promptly dismiss with prejudice any pending proceeding based upon any Claim released by this Agreement, and shall execute such documents as are reasonably necessary to effectuate dismissal.

Each Party represents and warrants that: (a) he or she has had a full and fair opportunity to disclose all material financial information; (b) he or she has the full right, power and authority to enter into and perform this Agreement; (c) this Agreement is executed voluntarily and without coercion; and (d) the execution and performance of this Agreement does not violate any other agreement or court order to which the Party is bound.

Notwithstanding the foregoing, disclosures to tax advisors, legal counsel, and necessary financial institutions are permitted, provided such recipients agree to maintain the confidentiality of the disclosed information.
