Any recording of a lien shall be subject to the priority of pre-existing recorded mortgages and liens of record.

7. Priority; Subordination

Any lien recorded pursuant to this Agreement shall be subject to existing recorded encumbrances having priority over the date of recordation. Claimant and Owner may, by written agreement, negotiate subordination of the lien to subsequent financing; absent such written subordination the lien shall have the priority set by date of recording.

What the Legal Slip and Fall Liens Form Is

The Legal Slip and Fall Liens Form is a formal written claim asserting a secured interest in potential settlement proceeds or judgments arising from a slip-and-fall personal injury matter. It documents the provider or claimant asserting entitlement to compensation for medical treatment, rehabilitation, or other recoverable expenses tied to the incident, and typically identifies the patient, provider, dates of service, services rendered, and the claimed lien amount. The form is used to notify insurers, opposing parties, and the court or claims administrator of the lienholder's asserted priority to be paid from any recovery.

Why a Proper Lien Form Matters

A correctly completed slip-and-fall lien preserves a provider’s or claimant’s right to recover fees from settlement or judgment funds, clarifies priority among creditors, and creates a written record for negotiation or litigation.

Why a Proper Lien Form Matters

Who Typically Prepares and Signs This Form

Each party has distinct responsibilities: prepare accurate records, confirm authorization, and follow jurisdictional filing and service rules to preserve lien priority.

  • Medical providers and billing departments asserting payment rights for treatment provided after an injury; documentation supports claims to settlement proceeds.
  • Personal injury attorneys who file, serve, and negotiate liens as part of case settlement and disbursement planning.
  • Patients or injured parties who sign assignments of benefits or authorization for providers to assert liens on their behalf.

Key Signatory Roles

Medical Provider

Facilities, hospitals, clinics, or individual practitioners that provided treatment. The provider must document dates of service, itemized charges, and any assignment or authorization from the patient to assert the lien and may need an authorized billing representative to sign.

Claimant/Attorney

The injured person or their attorney who acknowledges the lien or assigns recovery rights. Attorneys often file and serve liens, coordinate with insurers, and include lien payoffs in settlement disbursement statements.

Core Elements of a Professional Lien Form

A complete slip-and-fall lien form is clear, itemized, and organized so courts, insurers, and opposing counsel can verify the claim quickly and treat it as part of settlement accounting.

Identifying Parties

Full legal names and contact information for claimant, provider, treating physician, and any attorney or billing agent to ensure accurate service and notice.

Incident Details

Date and location of the slip-and-fall incident plus a brief description tying treatment to the event for nexus and causation purposes.

Treatment Record

Itemized list of treatment dates, CPT codes or service descriptions, providers seen, and medical record references that substantiate the lien amount.

Amount Claimed

Specific dollar amount of the lien, any accrued interest or collection fees, and whether the lien covers future as-yet-unbilled charges.

Authorization

Patient signature or assignment of benefits authorizing the provider to assert a lien and receive payment from settlement or judgment funds.

Authentication

Signature block with printed name, title, date, and notarization or witness section if required by jurisdiction to perfect the lien.

Step-by-Step: Completing and Issuing the Lien

Follow a consistent sequence to prepare, sign, serve, and file the lien to preserve rights and avoid procedural defects.

  • 01
Gather Records: Collect itemized bills, treatment notes, and authorization documents.
  • 02
Complete Form: Enter parties, dates, itemization, and exact lien amount.
  • 03
Authenticate: Sign, date, and notarize if required by state law.
  • 04
Serve and File: Serve insurers/parties and file where the claim requires (court or clerk).

Typical Filing and Notice Flow

A predictable routing sequence helps ensure notice reaches all interested parties and that the lien is effective for settlement distributions.

  • Prepare Document: Draft form and attach supporting records.
  • Signatures & Notary: Obtain signatures and notary if necessary.
  • Service: Serve insurer, defendant, and counsel following jurisdictional rules.
  • File: File with court clerk or claims administrator as required.

Digital Workflow Settings for Online Completion

File Types and Integrations for e-Submission

Confirm the eSignature provider supports required authentication and produces an immutable audit trail for disputes or court review.

  • File Formats: PDF, Word DOCX, and image attachments
  • Integrations: Common: Salesforce, NetSuite, Microsoft 365, Google Workspace
  • Audit Records: IP, timestamps, and signer authentication logs

Security and Compliance Considerations

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Comprehensive IP, timestamp, and action logs
HIPAA: HIPAA available (BAA required) for PHI
ESIGN/UETA: Compliant with ESIGN and UETA standards
SOC 2: SOC 2 Type II certification available
21 CFR Part 11: Compliant options for regulated records

Potential Penalties and Risks

Missed Deadline: Loss of lien priority
Incorrect Party: Service failure and potential dismissal
Insufficient Detail: Disputed or reduced lien amount
Unauthorized Filing: Ethical or contractual disputes
Unnotarized Signature: Noncompliance where notarization required
Improper Service: Delays in enforcement or court rejection

Common Preparation Pitfalls to Avoid

  • Failing to attach supporting medical records, which undermines the lien’s factual basis and invites dispute.
  • Using inconsistent names or case numbers that prevent matching the lien to the correct claim or court file.
  • Omitting authorization or assignment language when the provider claims payment rights on behalf of the patient.
  • Neglecting jurisdictional filing or service rules that vary by state and may make the lien ineffective.

Real-World Examples of Lien Use

These examples show how different parties use the lien form in common scenarios and what outcomes they seek.

Clinic Recovery

A community clinic documents $9,800 in services after a patient’s slip at a supermarket

  • The clinic files a lien against anticipated settlement funds
  • The itemized records and assignment language helped the clinic receive full payment at disbursement.

Attorney Coordination

A claimant’s attorney collects provider liens and includes them in settlement demands

  • The attorney negotiates reduced lien payoffs to obtain client release
  • Consolidated lien statements streamline settlement accounting and expedite final distribution.

Timelines and Filing Considerations

Timing for asserting and perfecting liens varies by jurisdiction and by whether the claim is administrative, insurer-managed, or litigated in court.

Statute of Limitations:

Personal injury SOL commonly ranges from two to six years depending on state

Prompt Filing:

File and serve lien as soon as provider recognizes a claim to preserve priority

Settlement Notice:

Serve lien before settlement disbursement to claim proceeds

Record Retention:

Keep originals and working files until final distribution plus statutory retention

Notary or Witness:

Comply with state-specific notarization or witness requirements where mandated

Key Processing Milestones

A sequence of milestones helps track the lien from preparation through final distribution to ensure timely action and protection of rights.
