What a Legal Statement of Declaration Is and When it’s Used

A Legal Statement of Declaration is a written, signed assertion by an individual or representative attesting to facts, observations, or legal positions under penalty of law. Declarations are commonly used in litigation, administrative proceedings, contract records, corporate books, and government filings to present sworn factual statements where an affidavit is not required. In many U.S. contexts a declaration carries evidentiary weight similar to an affidavit when properly signed, dated, and, where required, notarized or witnessed; electronic execution is permissible subject to ESIGN and applicable state law.

Why a Carefully Prepared Declaration Matters

A clear declaration creates an authoritative record of facts and dates that courts and agencies can rely on, reducing disputes and delay.

Why a Carefully Prepared Declaration Matters

Who Typically Prepares or Signs These Declarations

Common users range from attorneys and executives to HR managers and public officials who need a concise sworn statement for records or proceedings.

  • Attorneys and paralegals preparing evidentiary statements for court or administrative filings.
  • Company officers or managers creating official corporate records or transaction statements.
  • Healthcare administrators, HR professionals, or government staff providing factual attestations for compliance or benefits.

Identify the appropriate signer early and confirm any notarization or witness rules that apply to the intended use or jurisdiction.

Representative Signers and Their Responsibilities

Estate Attorney

An attorney prepares declarations to support pleadings, verify facts, and attach documentary evidence. The attorney ensures proper language, confirms signatory capacity, and advises on notarization or witness needs to preserve admissibility.

HR Manager

An HR manager completes declarations for employment verification or internal investigations, confirming dates, actions, and witnesses. They ensure personnel records align with the declaration and retain supporting documentation per retention rules.

Core Elements Every Professional Declaration Should Include

A properly structured declaration combines factual clarity with formal identifiers so it is admissible and enforceable. The following elements help ensure the document meets legal and administrative expectations.

Caption

Case or matter title and docket or file number where applicable.

Declarant Identity

Full legal name, role or title, and contact details for follow-up.

Statement of Facts

Chronological, first‑person facts limited to the declarant’s personal knowledge.

Signature and Date

Handwritten or electronic signature plus MM/DD/YYYY execution date.

Declaration Clause

Language stating truth under penalty of perjury or applicable statute.

Notary / Witness Block

Notary acknowledgment or witness lines when jurisdiction or purpose requires.

Compliance and Security Considerations for Electronic Declarations

In-transit encryption: TLS 1.2/1.3 in transit
At-rest encryption: AES-256 at rest
Audit trail: Comprehensive timestamps and IP logs
Regulatory certs: SOC 2 Type II available
Health data: HIPAA with BAA required
FDA records: 21 CFR Part 11 support

Step-by-Step: Completing a Legal Statement of Declaration

Follow these sequential steps to draft, verify, and execute a declaration suitable for court, agency, or internal recordkeeping.

  • 01
Draft clearly: Write concise first‑person factual statements.
  • 02
Include identifiers: Add case caption, dates, and contact information.
  • 03
Add declaration clause: State the penalty-of-perjury language required.
  • 04
Sign and authenticate: Sign, notarize, or witness as needed.

Routing and Filing: Where Declarations Typically Go

Declarations can be retained in an internal record, attached to filings, or transmitted to external parties. Follow the sequence below to ensure correct routing and proof of delivery.

  • Attach to filing: Include with court or agency submission.
  • Send to recipients: Email or eDelivery to opposing counsel or agency.
  • Store master copy: Keep original signed copy in records.
  • Maintain audit log: Retain full audit trail for verification.

How to Configure an Online Declaration Workflow

Set up your digital workflow to collect signatures, enforce authentication, and store an immutable audit trail before sending a declaration for signature.

Field Configuration
Signature authentication Email + SMS code or stronger
Mandatory fields Make name, date, and clause required
Notary integration Enable RON or in-person notarization option
Retention policy Define export and archive settings

Technical Requirements for Digital Signing and eSubmission

Confirm platform compatibility, authentication options, and accepted file formats before sending or accepting an electronic declaration.

  • Integrations: Salesforce, NetSuite, Microsoft 365
  • File formats: PDF, DOCX, HTML compatible
  • Authentication: Email, SMS, KBA, or SSO

Common Mistakes to Avoid When Preparing a Declaration

  • Omitting the declaration clause or incorrect statutory language can render the document inadmissible or require re-execution.
  • Using vague, hearsay, or opinion-based phrasing instead of first-person factual statements weakens evidentiary value in court.
  • Mismatched signer names, wrong dates, or unsigned pages create continuity gaps and may lead to rejection by courts or agencies.
  • Failing to notarize or obtain required witnesses when jurisdiction or filing rules demand them can void the declaration.

Potential Consequences of an Incorrect or Falsified Declaration

Perjury Risk: Criminal exposure under state law
Civil Liability: Damages for false statements
Evidentiary Loss: Declaration may be excluded
Filing Rejection: Court or agency may refuse
Notary Sanctions: Penalties for improper notarization
Operational Delay: Rework and administrative costs

Practical Tips for Accurate and Efficient Completion

Apply consistent editorial and review practices to reduce errors and preserve evidentiary integrity when using declarations in legal or administrative workflows.

Use precise first-person language
Limit statements to what the declarant personally observed or knows; avoid speculation and cite documents by exhibit numbers.
Confirm signer identity
Use government ID, matched name fields, and strong authentication for digital signatures to prevent later disputes.
Record supporting evidence
Attach or reference documents, emails, or logs that substantiate factual claims and retain originals per retention policy.
Validate jurisdictional formality
Check whether notarization, witnesses, or specific statutory wording is required for the declaration’s intended purpose.

Practical Examples: How Organizations Use Declarations

Real-world examples show how declarations streamline workflows, support filings, and reduce the need for in-person execution.

Martin Properties (Tim Martin, Founder)

Tim used declarations for remote lease attestations to complete closings without in-person meetings

  • Quick mobile signing enabled remote clients to execute documents
  • He reports consistent compliance with internal policies and faster turnaround when declarations were combined with complete audit trails.

Fertility Centers of Illinois (John Butler, Founder)

John relied on online declarations to collect patient attestations and consent during remote intake

  • Integration with record systems preserved continuity
  • The approach reduced manual paperwork, saved staff time, and maintained HIPAA-compliant logging for audits.
