What the Legal Suit Request Form Is

The Legal Suit Request Form is a standardized internal document used to collect the information a law firm, claims unit, or in-house counsel needs to evaluate and, if authorized, file a civil lawsuit. It centralizes claimant and defendant details, factual summary, damages claimed, supporting exhibits, jurisdiction and venue preferences, and a signing block that documents authorization to proceed. The form helps reduce back-and-forth, ensures consistent intake, and creates an auditable record of the decision to initiate litigation.

Why a Clear Request Form Matters

A complete Legal Suit Request Form speeds intake, clarifies authority to sue, and reduces filing errors. Properly executed forms create an auditable record that supports decisions and preserves evidence, while remaining compatible with electronic signature rules under the ESIGN Act (15 U.S.C. ch. 96, 2000) and most state UETA statutes.

Why a Clear Request Form Matters

Who Typically Completes or Receives This Form

Common users include claims examiners, paralegals, outside counsel intake teams, and business-unit managers who authorize litigation.

  • Claims departments and adjusters — prepare case facts, reserves, and prior settlement offers in structured form for legal review.
  • In-house legal teams — intake standardized requests to confirm jurisdiction, client authority, and litigation strategy before filing.
  • Outside counsel intake staff — use the form to gather exhibits, client declarations, and authority to accept service and fees.

The completed form routes to the responsible attorney or filings coordinator and becomes part of the case intake file.

Who Signs or Authorizes the Request

Client Representative

A company officer or claimant who has authority to instruct counsel. The signatory should be named by title and must have documented corporate authority or power of attorney to litigate on the claimant's behalf; mismatched authority can delay filing or produce standing challenges.

Managing Attorney

A licensed attorney who accepts the matter for filing. The attorney's signature confirms legal review, scope of representation, jurisdiction selection, and agreement to follow applicable court filing rules and deadlines.

Common Mistakes to Avoid

  • Missing or inconsistent party names that do not match government IDs or corporate formation records, causing delays or amended pleadings.
  • Insufficient factual summary or unsupported damages calculations that require follow-up and can miss statute of limitations milestones.
  • Omitting required exhibits such as contracts, demand letters, or proof of notice, which can impair initial case assessment.
  • Using unsigned or poorly authorized request forms that lack a clear corporate signatory or power of attorney, risking disputed authority.
