What a Legal Survey Affidavit Is and when it’s used

A Legal Survey Affidavit is a sworn written statement by a licensed surveyor describing a property's boundaries, improvements, easements, encroachments, and other physical attributes relevant to title and land use. It attaches to title packages, loan closings, permitting, and property conveyances to confirm facts shown on a survey. The affidavit typically identifies the surveyor, references the survey file and date, lists observed discrepancies from record descriptions, and certifies that the statements are true to the surveyor’s professional knowledge under penalty of perjury.

Why this affidavit matters for title, lending, and permitting

The affidavit provides a sworn, traceable record that links a specific survey to a transaction, reducing title risk and clarifying boundary or encroachment issues. It supports lender underwriting, insurer review, municipal permit approvals, and closing checklists while documenting professional responsibility from the surveyor.

Why this affidavit matters for title, lending, and permitting

Who prepares and who relies on the Legal Survey Affidavit

Roles vary: attorneys and municipal plan reviewers also review affidavits, especially where discrepancies or easements affect legal rights or approvals.

  • Licensed surveyors preparing and certifying survey observations for title, permitting, and closing purposes.
  • Title companies and underwriters verifying boundary data before issuing or endorsing title insurance.
  • Lenders and mortgage underwriters requiring a survey-based affidavit for collateral evaluation and loan close.

Core sections a professional Legal Survey Affidavit should include

A consistent structure helps ensure the affidavit is accepted by title companies and other reviewers. Include identification, reference to the survey document, factual statements, exceptions, certifications, and signature/notary elements.

Survey Reference

Identify the survey by date, job number, scale, and prepared-for party. This ties the affidavit directly to a single survey drawing and prevents ambiguity in later review or recording.

Property Description

Provide the full legal description or assessor parcel number and street address. Accurate parcel identifiers ensure the affidavit applies to the correct tax lot and recorded title chain.

Observed Conditions

List boundary monuments, visible improvements, fences, encroachments, easements, and other physical conditions observed during fieldwork that affect the survey conclusions.

Exceptions

State any limitations, such as lack of control monuments, incomplete title research, or inability to access parts of the property, so recipients know the affidavit’s factual bounds.

Certification Language

Include explicit sworn language that the statements are true to the surveyor’s knowledge and belief, dated and signed under penalty of perjury as required by local practice.

Notary Block

Provide a notary acknowledgement or jurat formatted to local notary statutes; include space for the notary seal, signature, and commission details if notarization is required.

Step-by-step: completing a Legal Survey Affidavit

Follow these sequential steps to prepare, sign, and deliver a complete affidavit that matches the survey record and satisfies common title requirements.

  • 01
Prepare Survey: Complete fieldwork and finalize the survey drawing.
  • 02
Draft Affidavit: Populate the affidavit referencing the survey job number.
  • 03
Review with Title: Confirm content satisfies title company exceptions and clarifies issues.
  • 04
Sign and Notarize: Surveyor signs in presence of notary if required.

Typical online workflow settings for eCompletion and routing

When completing the affidavit electronically, configure signer roles, authentication, and delivery options to match legal and title requirements.

Field Configuration
Signer Role Assignment Assign surveyor as primary signer; allow view-only for title.
Authentication Level Use email plus SMS code or identity verification for the surveyor.
Notary Options Enable remote notarization field if state RON is permitted.
Final Delivery Auto-send executed PDF and audit trail to title and lender.

How eSigning and delivery typically flow for this affidavit

An efficient eSigning process preserves the affidavit record and ensures recipients receive both the signed PDF and the verification audit trail.

  • Upload Document: Sender uploads affidavit PDF and links to the survey.
  • Place Fields: Add signature, date, and notary fields as required.
  • Authenticate Signer: Signers verify via email or two-factor method.
  • Deliver Copies: System sends executed PDF plus certificate of completion.

Technical requirements for eSubmission and notarization

Confirm the selected provider supports remote notarization where allowed and retains a tamper-evident audit trail for the signed affidavit and related survey files.

  • File Types: PDF, DOCX supported
  • Authentication: Email, SMS, KBA options
  • Integrations: Works with common CRMs

Timing considerations and common deadlines

While the affidavit has no universal statutory deadline, certain transaction steps and filing windows make timely completion important for closings and insurance.

Closing Deadlines:

Provide affidavit before or at closing to remove title exceptions.

Permit Submissions:

Attach affidavit when required by municipal permitting to avoid review delays.

Recording Window:

Record related documents promptly to lock in priority where required.

RON Retention:

If notarized remotely, retain AV records per state RON rules.

Title Review:

Allow sufficient time for title companies to accept or request amendments.

Common preparation errors to avoid

  • Attaching an affidavit that references the wrong survey date or job number, which breaks the link between sworn statements and the underlying drawing.
  • Using abbreviated or imprecise legal descriptions that differ from recorded deeds and create title company exceptions.
  • Omitting observed exceptions or limiting language, causing surprise issues during underwriting or closing.
  • Failing to notarize when a title company or local law requires it, leading to refusal by insurers or delays.

Risks and potential consequences of incorrect affidavits

Title Exception: Unresolved exceptions remain on title coverage.
Closing Delay: Transactions may be postponed for corrections.
Liability Exposure: Surveyor may face claims or malpractice suits.
Insurance Denial: Title insurer may deny coverage for undisclosed issues.
Notary Rejection: Noncompliant notarization can invalidate the affidavit.
Record Discrepancy: Mismatched records can complicate future conveyances.

Security and compliance considerations for the affidavit record

Encryption: TLS 1.2/1.3 in transit
At Rest: AES-256 encryption used
Audit Trail: Signed PDF must include timestamp and IP
HIPAA Support: BAA may be required for health-related parcels
Access Controls: Role-based permissions recommended
Standards: SOC 2 and ISO 27001 strengthen controls
