The Applicant represents and warrants that all information provided in this Application and in accompanying documents is true, complete and correct to the best of Applicant's knowledge. Applicant understands that any material misstatement, omission or concealment of fact may result in denial of the visa, revocation of any visa issued, deportation, fines, or criminal prosecution under applicable immigration laws.

Applicant further certifies that Applicant has disclosed any prior visa refusals, removals, deportations, criminal convictions, or immigration violations, and acknowledges the duty to promptly notify Representative and the Authorities of any change in circumstance material to the Application.

6. AUTHORIZATION AND CONSENT

Applicant authorizes Representative to prepare, sign and submit this Application and to receive and respond to communications from the Authorities on Applicant's behalf. Applicant authorizes the release and exchange of information between any third parties and the Authorities, including but not limited to educational institutions, employers, health providers, financial institutions, and law enforcement agencies for the purpose of verifying information submitted in connection with this Application.

7. FEES, PAYMENT AND COSTS

Applicant acknowledges responsibility for payment of all applicable governmental filing fees, biometric fees and any fees charged by Representative. Fees paid in connection with governmental processing are non-refundable even if the Application is denied. Representative's fees, if any, shall be separately agreed in writing and are payable pursuant to the terms agreed between Applicant and Representative.

Representative agrees to maintain confidentiality of Applicant's personal data and records to the extent required by applicable law, except to the extent disclosure is required by the Authorities or requested by Applicant. Applicant consents to storage and processing of personal information by the Representative and Authorities for the purpose of processing the Application.

10. INDEMNIFICATION AND LIMITATION OF LIABILITY

Applicant agrees to indemnify, defend and hold harmless Representative from and against any and all losses, liabilities, claims, costs and expenses (including reasonable attorneys' fees) arising from Applicant's breach of this Application, misrepresentations, omissions, or failure to disclose material facts. Representative's liability arising from any act or omission in connection with this Application shall be limited to direct damages and shall not include consequential, incidental or punitive damages.

11. GOVERNING LAW; ENTIRE AGREEMENT; SEVERABILITY

This Application shall be governed by and construed in accordance with the laws of the jurisdiction agreed by the parties below. This document constitutes the entire agreement between Applicant and Representative concerning the matters addressed herein and supersedes prior written or oral communications. If any provision of this Application is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. AMENDMENTS; WAIVER; COUNTERPARTS

No amendment to this Application will be effective unless in writing and signed by both Applicant and Representative. Waiver of any breach shall not constitute waiver of any other or subsequent breach. This Application may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument.

13. CRIMINAL AND IMMIGRATION HISTORY DECLARATION

Applicant must disclose any arrests, charges, convictions, removals, deportations, or prior visa denials. Failure to disclose such information may lead to denial or revocation of a visa and potential civil or criminal penalties. Applicant declares under penalty of perjury that the information provided is true and correct.

AUTHORIZATION TO ACT

Applicant hereby authorizes Representative to: prepare and file the Application; sign routine forms; receive official correspondence and decisions; collect and transmit supporting documentation; and to withdraw the Application upon instruction from Applicant. This authorization continues until revoked in writing by Applicant, provided that revocation will not affect actions taken by Representative prior to receipt of such revocation.
