What the Legal Wire Fraud Form Is and When it’s Used

The Legal Wire Fraud Form is a structured affidavit-style record used to report suspected or confirmed wire-transfer fraud to banks, insurers, and investigators. It documents parties involved, transaction identifiers, timestamps, routing and account details, a concise incident narrative, and supporting attachments such as emails, screenshots, or payment advices. Completing the form preserves contemporaneous evidence that banks and law enforcement rely on for tracing funds, and it creates a clear record for civil claims or insurance recovery. The form may be completed electronically where permitted under federal and state e-signature law.

Why a Formal Wire Fraud Record Matters

A Legal Wire Fraud Form preserves essential details that enable banks, regulators, and prosecutors to investigate and trace diverted funds. Properly executed forms support electronic signature validity under the ESIGN Act (15 U.S.C. ch. 96) and applicable state UETA rules, improving evidentiary weight and response coordination.

Why a Formal Wire Fraud Record Matters

Typical users and distribution of the form

Common preparers and recipients of a Legal Wire Fraud Form include corporate finance teams, bank fraud units, outside counsel, and law enforcement agencies.

  • Corporate treasury and accounts payable teams—document suspected diversion, preserve audit evidence, and provide transaction identifiers to banks and auditors.
  • Bank fraud units and financial institution compliance—use the form to open investigations, request traces, and coordinate holds or recalls.
  • External counsel and law enforcement—rely on a completed affidavit to support criminal referrals or civil recovery efforts.

Limit distribution to necessary parties and maintain secure channels when sharing details to protect personally identifiable information and privileged communications.

Who typically completes and signs the form

Corporate Treasurer

As the party responsible for outgoing wires, the treasurer supplies payee account details, supporting communications, and a signed incident statement to trigger bank tracing and internal recovery workflows; accuracy of dates and transaction IDs is crucial.

Closing Attorney

In escrow or real estate frauds, the closing attorney attaches closing documents and tracing evidence, certifies communications, and coordinates with title insurers and banks to support indemnity claims or return-of-funds requests.

Key components to include on a professional form

A complete Legal Wire Fraud Form organizes facts so banks, insurers, and investigators can act quickly; include structured fields, clear chronology, and verifiable identifiers.

Incident summary

Provide a concise chronological narrative describing what occurred, the method of the scam, dates and times, who initiated the transaction, and how the fraud was first detected; clarity reduces follow-up time from investigators.

Transaction identifiers

List payment dates, amounts, originating and beneficiary bank names, routing numbers, account numbers, wire reference codes, and any confirmation IDs that enable financial institutions to trace funds across correspondent banks.

Recipient information

Supply full legal name, address, phone, email, and any known business names or doing-business-as entries for the payee to assist recovery and law enforcement inquiries.

Supporting evidence

Attach documents such as emails, payment advices, remittance instructions, screenshots, contract excerpts, and IP headers where available; label each attachment and cite it in the incident narrative.

Legal declaration

Include a clear signer declaration under penalty of perjury or similar legal attestation, stating the truthfulness of the facts and the signer’s authority, dated and signed in the appropriate block.

Signature and authentication

Capture the signer’s printed name, title, signature, date, and the chosen authentication method (electronic signature, notarization, or RON) and note any multi-factor authentication used during e-signing.

Step-by-step: completing and submitting the form

Follow these steps to prepare, validate, and deliver the Legal Wire Fraud Form to banks and investigators in a way that preserves evidence and streamlines response.

Typical delivery and response workflow

A predictable workflow helps institutions act quickly: prepare the form, submit to the bank, and follow law enforcement procedures while preserving the audit trail.

  • Prepare form: Complete fields, attach evidence, and sign.
  • Submit to bank: Use bank fraud email or secure upload channel.
  • Notify law enforcement: File a police report and provide the affidavit.
  • Track response: Record bank trace IDs and investigator contact details.
