ASSUMPTION OF RISK AND RELEASE OF LIABILITY

Participant Name: hereby acknowledges that participation in the Class involves physical exertion and risk of bodily injury, including serious injury or death, and damage or loss of personal property. Participant voluntarily and knowingly assumes all risks, whether known or unknown, inherent to the Class and related activities, including but not limited to equipment failure, slips and falls, contact with other participants, and unsafe conditions in the facility.

In consideration of being permitted to participate, Participant and Participant's heirs, executors, administrators and assigns, on behalf of themselves and their personal representatives, hereby release, waive, discharge and covenant not to sue Provider, its owners, officers, employees, agents and contractors (collectively, "Released Parties") from any and all liability, claims, demands, actions or causes of action arising out of or related to any loss, damage or injury, including death, that may be sustained by Participant while attending or participating in the Class, whether caused by the negligence of the Released Parties or otherwise.

INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, demands, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of or resulting from Participant's negligent, reckless, intentional or willful acts or omissions in connection with participation in the Class.

Participant affirms that Participant is physically able to participate in the Class and has disclosed any medical conditions that may affect participation. Either party may terminate this Agreement for material breach by the other party if such breach is not cured within the stated notice period. Provider reserves the right to remove Participant from the Class for safety reasons, misconduct, or failure to follow instructions; removal does not waive Provider's right to collect unpaid fees.

CONFIDENTIALITY

The parties acknowledge that certain non-public information may be disclosed in connection with the Class. Each party agrees to hold confidential and not disclose to third parties any proprietary information disclosed in writing and marked confidential or that should reasonably be understood to be confidential. This section does not restrict disclosure required by law.

PHOTO/VIDEO RELEASE

I consent to the use of photographs and video recordings of me taken in connection with the Class for promotional, instructional or archival purposes, without further notice or compensation. If not checked, Provider agrees not to use images of Participant for promotional purposes.

GOVERNING LAW; ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflicts of law principles. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous understandings, proposals, representations and agreements, whether written or oral.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any breach shall constitute a waiver of any subsequent breach.
