LIABILITY WAIVER APPLICATION

This Liability Waiver Application (the "Agreement") is made as of / / by and between Participant Name: (hereinafter "Participant") and Facility/Operator Name: (hereinafter "Operator").

RECITALS

WHEREAS, Operator conducts, owns, operates, or arranges the activity or event described in this Application and Participant desires to participate in such activity; and

WHEREAS, Operator requires execution of this Agreement as a condition to participation in order to allocate and limit liability between the parties and to obtain certain representations and assurances from Participant; and

WHEREAS, Participant desires to make certain disclosures and provide contact and medical information for use in case of emergency and for Operator's safety assessment.

NOW, THEREFORE, in consideration of the mutual covenants and promises set forth below, the parties agree as follows:

2. DEFINITIONS

For purposes of this Agreement, "Released Parties" means Operator and its officers, directors, employees, agents, volunteers, affiliates, contractors, successors and assigns. "Claims" means all claims, demands, causes of action, liabilities, losses, costs and expenses, including attorneys' fees, arising out of or related to Participant's participation in the Activity.

3. ASSUMPTION OF RISK

Participant acknowledges and understands that participation in the Activity involves inherent risks, including but not limited to physical injury, property damage, disability, death, and economic loss. Participant knowingly, voluntarily and expressly assumes all such risks, whether known or unknown, foreseen or unforeseen, and whether caused in whole or in part by the negligence of the Released Parties.

4. RELEASE, WAIVER AND COVENANT NOT TO SUE

In consideration of being permitted to participate, Participant, on behalf of Participant and Participant's heirs, assigns, representatives and next of kin, hereby releases, forever discharges and agrees to indemnify and hold harmless the Released Parties from any and all Claims, demands, suits, judgments, losses, costs and expenses (including reasonable attorneys' fees) arising out of or in connection with Participant's participation in the Activity, including Claims arising from the negligence, omission or fault of any Released Party, to the fullest extent permitted by law.

5. INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all Claims brought by or on behalf of Participant or any third party arising from Participant's acts, omissions, negligence or breach of this Agreement, including costs of investigation and attorneys' fees incurred by the Released Parties in defending any such Claims.

6. REPRESENTATIONS AND WARRANTIES

Participant represents and warrants that Participant is physically fit and capable of participating in the Activity, has no medical condition that would impair Participant's ability to participate, and will disclose any material medical or other condition below. Participant further warrants that Participant is not under the influence of alcohol, controlled substances, or any medication that could impair Participant's abilities during the Activity.

7. INSURANCE AND COSTS

Participant acknowledges that Participant is responsible for obtaining and maintaining health, accident or other insurance coverage to cover any injuries or property damage sustained while participating in the Activity. Participant understands and agrees that Operator is not responsible for medical expenses or loss of personal property.

I acknowledge that I have read this Agreement in full, understand its terms, and freely and voluntarily consent to its provisions.

I authorize Operator to obtain emergency medical treatment for me if deemed necessary and agree to be responsible for all costs associated with such treatment.

I grant Operator permission to use photographs or video of Participant taken during the Activity for promotional and safety purposes, subject to Operator's customary practices.

10. MINOR PARTICIPANT

11. NOTICES

All notices required or permitted under this Agreement shall be in writing and shall be delivered to the addresses set forth below by hand, certified mail (return receipt requested), or nationally recognized courier service.

12. AMENDMENTS AND WAIVER

No amendment, modification, or waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties. The failure of either party to enforce any right shall not be deemed a waiver of that right in the future.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state specified below, without regard to its conflict of laws principles.

14. ENTIRE AGREEMENT; SEVERABILITY

This Agreement constitutes the entire agreement between Participant and Operator concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. COUNTERPARTS AND ELECTRONIC SIGNATURES

This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument. Signatures transmitted by electronic means shall be binding and have the same force and effect as original signatures.
