Lender Conditions and Remedies

Lender may, in its sole discretion, condition approval of this disbursement upon receipt of additional documentation, completion of inspections, receipt of lien waivers or cure of any outstanding defaults. Lender expressly reserves the right to withhold, reduce or delay any disbursement where Lender determines that the Loan Documents, applicable law, or the project status do not justify payment. Disbursement shall not be deemed effective until funds are released by Lender. Borrower acknowledges that events of default permit Lender to accelerate repayment, suspend disbursements, set off sums owed, and pursue all remedies available under the Loan Documents and applicable law.
