LODGE LEASE AGREEMENT

This Lodge Lease Agreement is entered into on between the parties identified below. Landlord and Tenant agree as follows.

Premises shall be used solely as a lodge, vacation residence, or short-term lodging as permitted by applicable law. Maximum occupancy shall be persons unless otherwise agreed in writing.

Subletting or assignment by Tenant is prohibited without prior written consent of Landlord. Unauthorized subletting or assignment is a material breach of this Agreement.

9. Maintenance and Repairs

Tenant shall maintain premises in a clean, sanitary and safe condition. Tenant is responsible for routine cleaning, minor maintenance, and replacements of light bulbs and batteries. Landlord is responsible for major structural repairs and systems unless damage results from Tenant's negligence.

10. Alterations and Improvements

Tenant shall not make any structural alterations, install fixtures, or make other permanent improvements without Landlord's prior written consent. Any approved alterations become Landlord's property unless otherwise agreed in writing.

11. Insurance and Indemnity

Tenant shall maintain liability insurance covering Tenant's use of the premises with minimum limits of and shall name Landlord as an additional insured where applicable. Tenant indemnifies and holds Landlord harmless from claims arising from Tenant's use or occupancy except to the extent caused by Landlord's gross negligence or willful misconduct.

13. Landlord Right of Entry

14. Default and Remedies

If Tenant fails to pay rent or otherwise breaches this Agreement, Landlord may pursue all remedies at law or equity, including termination of tenancy, recovery of possession, rent arrears, damages, and reasonable attorneys' fees and costs. Tenant shall be responsible for all costs of enforcement.

15. Holdover

If Tenant remains in possession after the expiration of the Lease without Landlord's written consent, Tenant shall be a holdover tenant and shall be liable for double the monthly rent for each month of holdover in addition to any other remedies available to Landlord.

16. Notices

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses set forth for Landlord and Tenant above by hand delivery, certified mail, or other delivery service providing proof of delivery.

17. Miscellaneous

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which the Premises are located. Venue for any action arising under this Agreement shall lie in the appropriate state or federal court within that state.

Entire Agreement: This document contains the entire agreement between the parties. Any amendments or modifications must be in writing and signed by both parties to be effective.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Attorneys' Fees: The prevailing party in any action to enforce this Agreement shall be entitled to recover reasonable attorneys' fees and costs.
