What a Lot Fit Agreement Is and When It Applies

A Lot Fit Agreement documents that a proposed structure, unit, or improvement can be placed, installed, or constructed on a specific parcel consistent with applicable measurements, setbacks, zoning, and site conditions. It allocates responsibilities for surveys, site preparation, approvals, and any corrective work required to achieve fit. Commonly used in manufactured-home placements, modular builds, infill construction, and developer lot reservations, the agreement clarifies acceptance criteria, inspection triggers, and steps for resolving discrepancies before permits or recording occur. It functions as a contract enforceable under general contract law when properly executed.

Why a Lot Fit Agreement Matters for Risk Control

A clear Lot Fit Agreement reduces ambiguity about who verifies site measurements, secures permits, and bears remediation costs. It protects owners, builders, and lenders by setting objective fit criteria and acceptance procedures.

Why a Lot Fit Agreement Matters for Risk Control

Typical parties who complete or receive a Lot Fit Agreement

The Lot Fit Agreement is completed by parties responsible for site suitability, approvals, and installation logistics before construction or placement begins.

  • Property owners and developers who control lot access and final approval
  • General contractors and site managers coordinating surveys and grading work
  • Lenders, title agents, or HOA representatives confirming compliance before funding

Use the agreement when site constraints could affect timeline, cost, or code compliance; tailor signatory authority and inspection steps to your project scale.

Who Can Sign and Their Typical Roles

Property Owner

The owner or an authorized company officer signs to acknowledge lot conditions and accept remediation responsibilities. The signer should have legal authority to bind title and approve access for surveys or construction.

Authorized Contractor

A general contractor or site superintendent signs to confirm responsibility for site preparation and to accept specified fit tolerances and inspection obligations laid out in the agreement.

Core elements to include in a professional Lot Fit Agreement

A comprehensive agreement balances technical fit criteria with clear responsibilities, timelines, remedies, and acceptance procedures to reduce disputes and permit delays.

Parties

Full legal names and contact information for owner, contractor, and any funding or title parties; include authorized signers and capacity (owner, agent, trustee).

Property Description

Legal description or parcel ID, street address, and reference to recorded plat or survey so the site is unambiguously identified for permitting and recording purposes.

Fit Criteria

Numeric tolerances and measurable benchmarks (setbacks, grade, size, utility clearances) that determine whether an installation 'fits' without additional work.

Survey & Plans

Which survey standard applies, who orders it, acceptable revision window, and which plans govern placement — attach exhibits where appropriate.

Approvals & Permits

Which approvals are required, which party secures each permit, and timing expectations tied to milestones or funding releases.

Acceptance & Remedies

Inspection process, acceptance criteria, remediation responsibility, dispute resolution method, and allocation of costs for corrective work.

Step-by-step: completing and executing a Lot Fit Agreement

Follow these sequential steps to prepare, verify, and finalize the Lot Fit Agreement so approvals and funding are not delayed.

  • 01
Prepare Draft: Draft parties, property, fit criteria, exhibits, and milestone dates.
  • 02
Order Survey: Obtain a current survey and confirm measurements used in the agreement.
  • 03
Review with Stakeholders: Have owner, contractor, lender, and title review for obligations and timing.
  • 04
Execute and Distribute: Collect signatures, retain originals, and provide copies to permit and funding parties.

How to set up an online workflow for the Lot Fit Agreement

Configure an e-signature workflow that secures identity, routes for approvals, and stores completed records for auditability.

Field Configuration
Signature Fields Place signature, date, and initial fields; require required-field validation.
Authentication Use email plus SMS code or ID verification for higher assurance signers.
Routing Order Define signing order: owner → contractor → lender/title.
Integrations Connect to cloud storage and title or project systems for archiving.

Where to send completed Lot Fit Agreements

After execution, distribute the agreement to parties that need it for permitting, title, funding, or HOA review.

  • Local Permit Office: Provide executed copy with survey and exhibits for permit application filing.
  • Title Company: Send for escrow, lien searches, and to confirm obligations affecting closing.
  • Lender / Funding Party: Deliver executed agreement to release funds or trigger disbursement milestones.
  • Contractor / Site Team: Share acceptance criteria and inspection checklist for on-site work.

Technology and format considerations for e-signing the Lot Fit Agreement

Choose a platform that supports common file formats, secure authentication, and audit trails for legal defensibility.

  • File Formats: PDF, DOCX, and fillable forms supported
  • Integrations: Salesforce, NetSuite, Microsoft 365, Google Workspace
  • Security: TLS in transit and AES-256 at rest

Ensure the chosen platform offers tamper-evident signed documents, access controls, and a reliable audit trail that meets contract or regulatory review needs.

Download, export, and archive options for completed agreements

Maintain copies in multiple formats and systems so signed agreements are accessible for permitting, title, and future audits.

PDF Export

Export a signed, flattened PDF with embedded audit trail for recordkeeping and county or lender submission.

DOCX Editable

Keep an editable DOCX master for revisions and generate a final signed PDF when execution is complete.

Cloud Archive

Store completed files in secure cloud storage with access controls and version history for audits.

CSV Metadata Export

Export signer metadata and dates for portfolio tracking or project milestone reconciliation.

Common mistakes to avoid when preparing a Lot Fit Agreement

  • Using vague fit descriptions rather than numeric tolerances, which leads to disagreement during inspections and rework.
  • Failing to attach the governing survey or stamped plans, which can invalidate fit determinations and block permits.
  • Allowing unapproved signatory authority, such as an unsigned proxy, which can create title or funding disputes.
  • Missing local permit or HOA conditions in the agreement, which may require costly post-execution amendments.

Risks and financial consequences of an incorrect or incomplete agreement

Permit Delays: Increased project costs
Funding Holds: Escrow or draw stoppage
Remediation Costs: Contractor or owner liabilities
Title Problems: Closing or recording issues
Regulatory Fines: Local code enforcement penalties
Contract Disputes: Potential litigation expenses

Typical timelines and processing expectations

Timelines vary widely by local authority and project complexity; the following are common expectations and checkpoints to plan around.

Survey Validity:

Surveys are typically valid for 6–12 months depending on local standards and site changes.

Permit Review:

Municipal permit review commonly takes 15–30 business days, longer for complex or conditional approvals.

Remediation Period:

Allow a defined window (often 10–30 days) for corrective actions after failed inspection.

Funding Milestones:

Tie lender disbursements to signed acceptance certificates or recorded documents with explicit dates.

Recordation:

County recording processing varies; expect 1–4 weeks depending on backlog and submission method.

Practical tips for accurate and efficient Lot Fit Agreements

Follow procedural and documentation best practices to minimize rework and ensure enforceability across parties and regulators.

Use Clear Measurements
Record numeric tolerances and reference standards (datum, measurement units). Ambiguity in measurements drives disputes and inspection rejections.
Attach Controlling Exhibits
Include the stamped survey, site plan, and permit exhibits as appendices; reference them explicitly in the body to avoid interpretation issues.
Define Inspection Steps
Specify who performs acceptance inspections, what instruments or standards will be used, and the window for corrective action.
Maintain an Audit Trail
Preserve executed originals or authenticated electronic copies with timestamps, signer identity verification, and change logs for future disputes.
