The plaintiff sustained injuries including serious pain and suffering and permanent disfigurement. 4. Upon the day of the accident, all named defendants were served with the petition for damages and the day of service the petition was granted in an order by the court on the same day. Plaintiff, the applicant, has indicated or stated that the incident took place, during a normal work day with no signs of excessive speed exhibited or an emergency call being made but on the day of the accident, on the roadway, when she/he was driving her/his car with the assistance of other persons .
