MAKEUP ARTIST SERVICES AGREEMENT

This Makeup Artist Services Agreement (the Agreement) is entered into as of Date: by and between Artist Name: and Client Name: .

RECITALS

WHEREAS, Artist is a professional makeup artist engaged in providing cosmetic application, consultation, and related services to clients; and

WHEREAS, Client desires to retain Artist to provide makeup services in connection with Client's event as described herein, and Artist agrees to provide such services under the terms and conditions of this Agreement.

WHEREAS, the parties wish to set forth the scope, payment, schedule, and other terms governing the provision of makeup services.

Cancellation by Client: Client may cancel by providing written notice to Artist. Deposit is non-refundable except where Artist cancels or fails to perform. If Client cancels within days prior to the event, Client will forfeit the deposit and may remain liable for additional portions of the total fee as set forth in the payment schedule.

Termination for Cause: Either party may terminate this Agreement for material breach by the other party if the breach remains uncured after days' written notice. Termination does not relieve Client of obligations to pay for services already rendered.

CONFIDENTIALITY

The parties acknowledge that Artist may gain access to non-public information regarding Client's event and personal preferences. Artist shall maintain in confidence any such non-public information and shall not disclose it to third parties except as required to perform services or as required by law. This obligation survives termination of this Agreement for a period of two (2) years.

LIMITATION OF LIABILITY; INDEMNIFICATION

Artist will exercise commercially reasonable care in performing services. Client acknowledges that reactions to cosmetic products may occur. Client agrees to disclose any allergies, skin conditions, or sensitivities prior to services. Artist's total liability for any claim arising out of or related to this Agreement shall not exceed the total fees paid by Client under this Agreement. Client shall indemnify and hold harmless Artist from and against any third-party claims, losses, or damages arising from Client's breach of this Agreement or from Client's failure to disclose medical or allergy information.

FORCE MAJEURE

Neither party shall be liable for delay or failure to perform due to causes beyond its reasonable control, including acts of God, public health emergencies, strikes, governmental actions, or severe weather. The affected party must provide prompt notice and use reasonable efforts to reschedule performance.

GOVERNING LAW; ENTIRE AGREEMENT

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of laws principles.

Entire Agreement: This Agreement, including any attachments or addenda signed by the parties, constitutes the entire agreement between Artist and Client and supersedes all prior negotiations, representations, and agreements, whether written or oral, relating to the subject matter hereof. Any amendments must be in writing and signed by both parties.

MISCELLANEOUS PROVISIONS

Assignment: Neither party may assign this Agreement without the prior written consent of the other party, except that Artist may subcontract services to qualified personnel as needed so long as Artist remains responsible for performance.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
