MAKEUP SERVICES CONTRACT

This Makeup Services Contract ("Agreement") is entered into by and between Service Provider: with address , and Client: , located at .

WHEREAS

1. Service Provider is engaged in the business of providing professional makeup application and related beauty services and holds the necessary qualifications, licenses, and insurance to provide such services.

2. Client desires to engage Service Provider to provide makeup services for the event described below, and Service Provider agrees to provide such services on the terms and conditions set forth in this Agreement.

3. The parties intend for this Agreement to set forth the complete understanding between them with respect to the subject matter herein.

Service Provider shall provide professional makeup services as described below. Services will be performed at the Event Location unless otherwise agreed in writing. The Scope of Work shall include specific services, timing, and number of persons to be serviced.

The deposit is required to secure the booking. Deposit is non-refundable except as provided in the Termination section.

Either party may terminate this Agreement for material breach if the breaching party fails to cure such breach within the notice period set forth above. If Client cancels within 72 hours of the Event Date, Client shall remain liable for the full fee. Service Provider may terminate immediately for failure to pay or for health and safety concerns.

CONFIDENTIALITY

Each party agrees that all non-public information, trade secrets, techniques, formulas, client lists, pricing, and other proprietary information disclosed in connection with this Agreement shall be held in strict confidence and shall not be disclosed to third parties without prior written consent. This obligation shall survive termination of this Agreement for a period of three (3) years.

CLIENT RESPONSIBILITIES AND ACKNOWLEDGMENTS

Client represents that Client has disclosed all allergies, skin sensitivities, and current topical or oral medications that could affect makeup application. Client agrees to arrive with a clean face free of heavy product unless otherwise agreed. Client acknowledges that Service Provider uses professional products and follows industry practices but does not guarantee allergic reactions. Client agrees to indemnify Service Provider for damages resulting from undisclosed allergies or contraindicated treatments.

MODEL RELEASE

Client hereby grants Service Provider the right to take and use photographs or video of the makeup work for marketing, portfolio, instructional, and promotional purposes without further consent or compensation, unless Client indicates otherwise in writing below.

LIABILITY, INSURANCE, AND INDEMNIFICATION

Service Provider shall maintain commercially reasonable liability insurance. To the fullest extent permitted by law, Service Provider's liability for any claim arising out of or relating to this Agreement shall be limited to direct damages not to exceed the total fees paid by Client under this Agreement. Neither party shall be liable for consequential or punitive damages. Client agrees to indemnify and hold Service Provider harmless from claims arising from Client's failure to disclose allergies, contrary medical conditions, or from Client's own negligence.

FORCE MAJEURE

Neither party shall be liable for delays or failures in performance due to causes beyond its reasonable control, including acts of God, strikes, government restrictions, or other force majeure events. The affected party shall provide notice to the other and make reasonable efforts to reschedule.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to its conflicts of law principles. Any dispute arising under this Agreement shall be resolved in the state or federal courts located in the county selected by Service Provider within that State.

ENTIRE AGREEMENT

This Agreement, including all attachments and the Scope of Work, constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written. Any modifications must be in writing and signed by both parties.

MISCELLANEOUS

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Headings are for convenience only and shall not affect interpretation. The parties are independent contractors, and nothing in this Agreement creates a partnership, joint venture, or employment relationship.
