MARATHON PARTICIPATION WAIVER

RECITALS

WHEREAS the Organizer operates and conducts the marathon event described below (the Event) for the purpose of competitive and recreational running; and

WHEREAS the Participant desires to participate in the Event and acknowledges that participation involves inherent risks that may result in personal injury, property damage, or death; and

WHEREAS in consideration of being permitted to participate, the Participant agrees to the terms and conditions set forth in this Waiver.

HEALTH, MEDICAL, AND AUTHORIZATION

The Participant affirms that they are physically fit and sufficiently trained to participate in the Event. The Participant understands participation may aggravate existing injuries or medical conditions and certifies that they have consulted a physician as necessary.

Medical Authorization: In the event of injury or medical emergency, the Participant authorizes event personnel and medical providers to administer emergency treatment deemed necessary. The Participant understands the Organizer is not responsible for medical costs; insurance information is provided as a courtesy.

ACKNOWLEDGMENT OF RISK; WAIVER AND RELEASE

ASSUMPTION OF RISK: The Participant knowingly and voluntarily assumes all risks related to participation in the Event, including but not limited to slips, falls, contact with other participants, exposure to weather, road hazards, route conditions, traffic, and negligent or intentional acts of third parties.

RELEASE AND WAIVER: The Participant, on behalf of themselves, their heirs, executors, administrators, assigns and agents, hereby releases, waives, discharges, and covenants not to sue the Organizer, its officers, directors, employees, volunteers, agents, sponsors, successors and assigns (collectively Releasees) from any and all liability, claims, demands, actions or causes of action whatsoever arising out of or related to any loss, damage, injury or death, whether caused by the negligence of the Releasees or otherwise, arising out of or in connection with participation in the Event.

INDEMNIFICATION

The Participant agrees to indemnify, defend and hold harmless the Releasees from and against any and all claims, causes of action, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising from the Participant's negligent, reckless or intentional acts or omissions in connection with the Event.

PHOTO AND MEDIA RELEASE

The Participant grants the Organizer the right to photograph, record, or otherwise capture Participant’s image, voice and likeness during the Event and to use such media for promotional, educational, or commercial purposes without further compensation to the Participant.

COVID-19 / COMMUNICABLE DISEASE REPRESENTATION

The Participant represents that to the best of their knowledge they are not currently infected with any communicable disease that could reasonably be transmitted during the Event and will comply with all health and safety protocols implemented by the Organizer. The Participant understands the Organizer cannot guarantee elimination of risk of transmission.

COMPLIANCE WITH RULES

The Participant agrees to follow all event instructions, applicable laws, and course marshals' directions. Failure to comply may result in removal from the Event without refund.

SEVERABILITY; GOVERNING LAW; ENTIRE AGREEMENT

If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be severed to the minimum extent necessary and the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the jurisdiction where the Event takes place, without regard to conflict of law principles. This Waiver constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements, understandings and representations.
