What the Marketing Digital Advisory Agreement Covers

Marketing Digital Advisory Agreement is a written contract between a marketing advisor and a client that defines the scope, deliverables, fees, timelines, ownership of intellectual property, confidentiality obligations, and performance metrics for digital marketing services. It aligns expectations for strategy, content, advertising spend, analytics reporting, and campaign management while allocating risks such as indemnity and limitation of liability. The agreement can be executed electronically under U.S. law when parties satisfy ESIGN and applicable state rules. Use clear, specific language to reduce disputes and support enforceability in commercial and regulated contexts.

Why Use a Written Marketing Advisory Agreement

Use this Marketing Digital Advisory Agreement to document responsibilities, fees, performance measures, and remedies in a clear, legally sound form. It reduces ambiguity, helps manage client expectations, and supports enforceability by recording consent, signature attribution, and retention consistent with ESIGN and UETA.
