What the Marketing Mascot Agreement Covers

A Marketing Mascot Agreement is a written contract that sets the terms between an organization and an individual or agency who performs as a brand mascot. It defines performance scope, appearance and costume ownership, compensation, schedule, exclusivity, intellectual property assignment for the mascot persona and any recorded materials, safety and conduct standards, and termination conditions. The agreement also assigns responsibilities for costume maintenance, storage, insurance, and any medical or accessibility accommodations. Properly drafted, it reduces ambiguity about rights, payment, and use of the mascot likeness across marketing channels.

Why a Formal Mascot Agreement Matters

Clear, written terms protect both the brand and the performer by documenting rights to the character, payment schedules, liability allocation, and permissible uses of recorded media, reducing disputes and enabling consistent marketing use.

Why a Formal Mascot Agreement Matters

Who Typically Enters a Mascot Agreement

Organizations and performers across industries use mascot agreements to manage character use, safety, and IP.

  • Small businesses and franchised locations needing clear performer obligations and local event coverage.
  • Colleges, professional sports teams, and large brands requiring IP assignment and wide media licensing.
  • Entertainment agencies or temp staffing firms managing multiple performers and costume custody.

Choosing the right signer and level of legal detail depends on the organization’s size, the mascot’s public exposure, and whether the performer is an employee, contractor, or agency.

Who Signs and What Their Role Is

Performer / Contractor

An individual or contract laborer who performs in the mascot role. The text assigns performance duties, outlines physical and conduct requirements, sets compensation and schedule, and clarifies that the performer does not own the mascot IP unless explicitly granted.

Company Representative

A company officer or delegated manager authorized to bind the organization. This signer accepts assignment of mascot rights, approves usage limits, and confirms insurance and safety requirements are met on behalf of the business.

Core Provisions to Include

A professional Marketing Mascot Agreement groups standard clauses into clear sections so both parties understand rights, risks, and operational expectations.

Scope of Services

Define performance types, hours, events, travel, rehearsal obligations, and any availability windows; specify who arranges transportation and per diem coverage.

Compensation

State payment amounts, timing, invoicing, expense reimbursement, late fees, and any bonus or penalty provisions tied to attendance or deliverables.

Intellectual Property

Assign character name, costume design, recorded media, and merchandising rights; specify whether assignment is exclusive, perpetual, or licensed and include moral-rights waivers where required.

Costume Ownership and Care

Clarify who owns the costume, storage responsibilities, cleaning, repairs, and replacement costs, plus rules for unauthorized modifications.

Liability and Insurance

Allocate responsibility for injury, property damage, and third-party claims; require certificates of insurance and specify minimum coverage limits.

Termination and Suspension

List termination triggers (breach, injury, voluntary leave), notice periods, final payments, costume return procedures, and post-termination IP restrictions.
